im not sure how this works but this picture has been around without me knowing and they are selling 2 versions of it without us knowing. im not sure if it its fair use because if its in the millitary or what.

You have never MET the person in the photo. The person in the photo DID give blanket consent to use such photos before they were allowed anywhere near where it was taken.

Can you sue? Sure, you don't have to prove anything to sue.
Can you win? Nope. They did not violate your privacy and who ever took the picture had the right to do so.
