Car accident settlement ?

How do you demand money after submitting all legal documents in a car accident that wasn’t my fault? I got all my treatment done and it’s time to settle the case. I don’t know what to say or how to stay it professionally

    Add up your medical expenses.  Multiply by five.  Add in lost wages, travel expenses, rental car and any other out of pocket expenses.  Just call the claims adjuster and say "I am ready to settle my claim.  I will do it for X number of dollars.

    Have your attorney handle it. If you don't have an attorney there's no sense talking with you.

    Then don't try to do it yourself.  

    Insurance companies don't just accept your paperwork and open their chequebook, they go through everything line-by-line and investigate all the little details before they even think about paying anything.

    The answers telling you to call your insurance company are nice, but that's not how it works in all jurisdictions with all auto policies.  You do need to tell them about this accident, because it says so in your contract with them, and definitely ask them if they can help you.  If they say they can't, then you need to lawyer up.

    I know, I know, lawyers are pond scum and nobody likes them.  There's a reason nobody likes them.  But they're necessary, because they know how this stuff works.  Whatever insurance company you're claiming through has a whole team of them, and insurance companies only hire the smartest, meanest and most ruthless lawyers in the business.

    If it isn't too late to do so, You should consider using your own insurance company.  They have free to you lawyers who will do all that needs to be done to make you whole.  If it is too late to use your own insurance, at least ask them for advice.  I agree with the other poster here that advised that hiring a lawyer should be your VERY LAST choice.  Any lawyer that you hire will end up with the lions share of anything he may get for you and you will get nothing but the scraps.

    Some people think you should 'lawyer up' first thing.  But I see that as a last resort.

    Call your insurance company and ask to talk to the adjuster in your case.  If you don't have insurance, call the other person's insurance company.  Have all your records handy--accident report, medical reports and bills, etc.  Tell them how much it actually cost you in health care, your car, lost work or whatever.  And let THEM make an offer.  They're the ones who know what these things cost and what they're worth.  Every insurance adjuster I ever spoke to was a real expert, easy to talk to, able to answer all my questions (and non-judgemental!)

    If you're happy with their offer, then you can negotiate.  You can give them a counter offer.  You can go back and forth with them.

    If you still can't get what you think you deserve, THEN you get a lawyer. 

    The thing about lawyers is that either you pay them by the hour (several hundred dollars per hour these days) or else they work on a 'contingency basis', meaning they get 1/3 to 1/2 of everything you get.  This is why you don't get one right away, because if the insurance company makes you a good offer and you're happy with it, the lawyer still gets his share!  So if the insurance company comes through, you're paying the lawyer thousands of dollars for nothing!

    You should be hiring an attorney and not trying to handle it yourself. They will get you much more than the insurance company will ever offer you.
