Old job is charging me for my w2?

I left Stater Brother's back in January after working there for 4 months and I never received my w2 from them. So I called them and let them know and they're trying to charge me $20 for another copy even though I never received the first one. What can I do about this? I shouldn't have to pay for another one if I never received the first copy!

    Don't pay.

    Tell them to send it asap or you will report them to the IRS.

    The law gives them to the end of January to supply it.

    On February 1 you should have been threatening them.

    You can do your taxes without it.

    Your check stubs give the same information.

    Send your 1040 imto the IRS with a complaint letter that they did not send you a W2 and they want to charge you for it.

    Your 1040 is already overdue.

    You should have filed for an extension.

    What have you been doing all these months?

    I learned how to do this in 12th grade, half a century ago.

    Call the IRS that you asked for a W-2 and didn't receive it. They'll try to get the company to send it to you, and they'll send you a substitute form so you can file without the W-2 if you still don't get it.

    Give them the $20.  Get a receipt.  If it is in fact a duplicate they are allowed to charge you.  Did you go to their website?  Perhaps you can access your W2 form there.

    And from now on be sure that you let former employers know of your current address - or leave a forwarding address with the post office - if you haven't already done this.

    Just tell them sure I will pay for it but tell them you will reporting them to the state for not sending it to you then charging you for it.

    Why did you not get the first one? You changed your address and didn't tell them? If it's YOUR fault you didn't get the first one, you pay.

    Your employer is required by law to provide you either a hard copy of your W2 or a free digital copy (if you opt for that) each year. If they have provided the required copy and you need another one then there is no statute barring them from charging for extras.

    The IRS permits employers to charge a fee for reissuing the form. The IRS states emphatically in their instructions for Form W-2 that "Employers are not prohibited (by the Internal Revenue Code) from charging a fee for the issuance of a duplicate Form W-2."However, it is best if charges for duplicate forms are stated up front in your procedures rather than as an afterthought once a duplicate is requested. This will prevent misunderstandings by employees who may have heard this myth and are under the impression that fees are not permitted.It is also not restricted on which employees are charged a fee and which are not. Again this is subject to your payroll policy. As long as the distinction of who is or who is not charged is not based on any criteria that can be traced back to a protected group such as race, creed, color, religion, sex, place of birth, or national origin it will be acceptable. It is becoming common to assess a fee if the employee did not receive the form due to their own inaction such as failing to update their address after a move. A fee is not assessed if the form indeed was "lost in the mail." You should not charge a fee to only employees who live in a certain state or city.

    Sounds like a lot, but it might be legal (administrative fee). Can't you get one online? 

    Check with the IRS. You might be able to file a complaint.
