Assault law questions ?
Hey guys now I needed to ask this question because my dad thinks the law works differently for him. I am 30 years old and live in New York. If my dad assaulted me and beat me up bad in his house, would my dad go to jail for assault and battery or would I be just be escorted out of the house by the police? My dad seems to think if he beat me up he wouldn’t be charged and I would just be removed from his house he’s delusional a bit. Thanks for all answers!

if you report it to the PD, yes he would be charged...may or may not go to jail, it would mostly likely just be a day.....and you may be able to get a restraining order if you also live in the house and he would have to find elsewhere to stay

He IS delusional. That's assault & battery no matter WHOSE house it's in. Your dad needs to go in a home. He's a danger to the general public. Being mentally deranged is NOT an excuse for committing a crime. It's just too bad that euthanasia is not yet legal because he'd be a prime candidate for it.

It depends on too many factors which you haven't posted. I am IN NY. I am familiar with NY law. Instead of whining about your father on a regular basis, YOU'RE 30 YEARS OLD. MOVE OUT!

If you are both adults, that would be domestic violence in my state which is a mandatory arrest. You are not immune to laws just because you are in your own home.

* IF he does hit you, telephone the Police asap. Tell them that you want to file a report, AND you want to press charges against him. Follow through.

Assault is always a criminal offence no matter where it occurs or the relationship between the individuals. Would he go to jail? The devil is in the details. If you hit him first, it might be you that goes to jail. But if your father is threatening to beat you up if you go to his house, stay away. You are 30 years old, simple.
