What does one do when council gets vindictive?
In this little Podunk borough, council has been getting what one might say "too big for their britches". When they construe an ordinance like their latest "junk vehicle" and they are stopped because of a portion being illegal they huddle and retrofit it to suit their needs. They recently gave borough police permission to trespass on private property. I was cited for two cars that are under separate car covers and my sons truck that is three quarters on his property. My one car (1 of 2 under a cover) is a drag racing car, I could get it inspected and plated but for why? I don't drive it on the streets.. it's a weekend toy. I explained this at a previous council meeting and everything was fine for a year till they hired this new cop. I ticked off the council members that rewrote the junk ordinance and it is my belief that they are behind this new effort to remove "junk vehicles". This to me smacks of abuse of position and power. According to council you can have a brand new vehicle on your property but if it is not inspected or plated it is junk and has to be removed. What if in this economy you lose your job and park your car? you better be able to keep it inspected and plated or not only is your job gone so is your car. Without a job can you afford to buy another? And since when is an officer of the law permitted to uncover anything to see what it is? There surely has to be a law that keeps the council in check? The Mayor uses president of council as his personal hand puppet to get a lot of things done. His maturity doesn't match his age. So folks is this borough in trouble or is there help out there? Thank you for taking your time to read this.
2 AnswersLaw & Ethics9 years agoAdverse possession of municipal property, are there any cases where a citizen won?
there is a 50'x 300' section of an un-opened, un-ordained, unused, only on the map street which borders my property. I and my family have maintained this parcel since we moved in. Cut the grass picked up after the several large trees. We want to claim it through Adverse possession but am told I can't because of it being municipal property. Surely I'm not the first to run up against this problem. Are there laws or cases that would support my position?
