Reckless driving in a construction zone?
My boyfriend was driving down the interstate in a construction zone (no workers were present- it was raining). He was driving alongside a semi going up a slight hill when the semi began to cross over into his lane. He was driving a rental car (a VW Jetta), so he was unfamiliar with the car. He pressed the gas to proceed around the semi, but the car didn't speed up. The semi continued to swerve so he pressed the gas even harder. This time the rental car took off and he zoomed around the semi truck. He was then pulled over and cited with reckless driving. He was doing 75 mph, and the normal speed limit is 70 mph, but because it was a construction zone it was 55 mph (even though there were no workers out there in the rain). He is 28 years old and has never had a speeding ticket or any other driving citations in his life.
Should he go to court and argue his case? How likely is the judge to reduce or drop the ticket? This happened in Alabama on I-20 outside of Birmingham.
