  • Is an adult stepchild living in my home who does not pay anything for expenses a tenant?

    My wife's son is 22 years old, and still living in my spare room. He was supposed to pay something each month, but for the past two years has not paid cent one. The question is, is he considered a tenant for the purpose of throwing him out? He is a drunk and verbally abusive to my wife, and he has tried to kill me on two separate occasions, the result of the second is that I walk with a cane to this day. At any rate, enough being enough, I just need to know if he is considered a tenant at law, and if I need to go through a formal eviction just to get his sorry behind out of my house?

  • Why are lawmakers convicted of illegal acts not punished?

    Senator Stevens of Alaska has just been convicted of seven felony charges in Federal Court, and now I read that not only will he probably not do day one in jail as a result, he will probably not even be disciplined by the Senate and allowed to seek reelection . WTH is wrong with the voters in this country? Anybody else in the same case would be looking at 35 years in prison yet OH GOODY! Another politician abuses his office and walks away scott free. I guess my real wonderment is why it seems so amazing that so many people are disgusted with the political system. Why dont we just throw the pack of them out and start over? Because clearly there is no accountability there.

    The error message is fixed drive failure code 200. Rather than go to all the bother of replacing the drive, isnt it possible to do the same thing with an external drive? Im trying this solution, but the system doesnt recognize the new drive. Is there something that Im missing?

    would like to post a few words about replicadungeon

    and their fine assortment of medieval swords as well

    as fantasy swords and various movie collectibles, all

    offered at very competitive prices. The selection of

    Japanese swords alone made me feel like a hungry kid

    in a candy store the first time that I saw it. From

    More impressive still is the information which their

    not only of the weapon itself, but also of the warriors

    who wielded them. I learned a good deal about the

  • In a bankruptcy proceeding, is not the government also bound by the automatic stay?

    If a litigant seeks to discharge a debt allegedly owed to the government, doesnt the government have to lift the automatic stay before it can collect on the alleged debt? This was a chapter 7 hearing in may of 2005. The debt in question is for student loans taken out in the 1980's.. There was no appearance or objection by any government agency at the 341 hearing, but now 18 months post discharge the Department of Education has resumed collection.

  • What recourse does a citizen have to appeal an illegal action by the government?

    I was forced into retirement by the IRS in retaliation for having made complaints to my elected representatives of

    certain abusive and illegal practices being used to attempt to

    force me to pay a tax debt owed by my wifes former spouse.

    My health has been destroyed, and I am now terminally ill with

    a degenerative heart condition, resulting from 6 years of this

    callous, unrelenting harassment. I was told that unless I paid,

    I could lose my job, or I could have my wages garnished.

    Despite filing chapter 7 in which my spouses student loans

    were also listed and discharged, the government has now

    seized my tax refund as well as my SSDI payment. As a result,

    I face eviction from my home due to inability to pay rent, as well

    as inability to buy medication that I need to live, among a list

    of other consequences too long to list.

    If there is a law firm out there who could help, or if anyone has any ideas at all, I am truly desparate.

  • May the government seize a tax refund to offset a debt discharged by operation of law?

    My spouse had student loans stemming from her prior marriage, which due to factors beyond her control she was not able to repay.

    These were incurred in the late 1980's. In 2005, she and I filed a

    Chapter 7 petition to discharge these debts, since we met the criteria established under In re Pena, decided in 1997. The Department of Education did not appear at the hearing, and they made no objection to the discharge of the debt. Now, two years after the petition was granted, the DOE claims that the debt was not subject to discharge, and in addition even though under law only half the refund should be seizable, DOE claims that they are entitled to the whole amount.

    First, can the government collect a debt that has been wiped out by operation of law? Can the government disregard those laws that it finds inconvenient? Second, a spouse is not supposed to be liable for the educational debts of the other spouse. So why are they entitled to the whole refund?
