  • can a motion to modify child custody be granted on default if the parent fails to respond?

    A few months ago we were granted an emergency custody hearing w/ CPS testifying on our behalf we were granted temporary custody at that time the other parent failed to show up- even though they admitted to our attorney they were aware of the hearing - the judge wanted to give additional time to respond so more paper work was file and they were give 30 days to respond which once again they did not do so now another hearing has been scheduled- we have heard that the other party is planning on showing up for the hearing even though they did not respond- my question is will we be granted custody by default and if not what will happen at the hearing as of right now the other party will be representing themselves if they do indeed show up at the hearing?

  • what is wrong with the court system today?

    I thought the court system when it comes to custody of children were suppose to be there for the children- how ever we just lost a custody hearing where the mother admitted to substance abuse- medical records showing a attempted suicide ( where the 10yr. old found her almost dead in April) assaults and theft charges. She had no attorney but the ruling was as follows: consider this a learning experience- take care of your kids- seems to be an isolated incident if the kids were suffering grades would be down - not enough evidence nor recent evidence we started the custody persuit 2 months after the last theft and while she was in the hospital w/ the OD plus solid proof of patterned behavior. How much do the kids need to suffer? We are now told it's on record not much you can do but wait for her to mess up again then start over- which makes matters worse as we don't even live in the same state. I think the court system needs to grow a set and start cracking down on parents like this man or woman and stop the pity party for them they chose to be parents step up to it or lose your rights- removing a child from that kind of situation is the best for the child what kind of person will they be learning to live like that? What is your opinion?
