  • 2nd Attempt RE: formulating legal principle from precedents?

Hopefully, I'm more clear in my question this time. Well, here it is...

How is it that a legal principle is formed using precedents? What are the most common principles used? What makes a certain case significant enough that a legal principle is actually formulated?

There are laws that are derived from legal precedents e.g. anti-cyberbullying statutes. How is it that a case can be so compelling that an actual statute/law is enacted regarding a certain issue?

Examples will be appreciated and may help understanding.

    Thanks!

  • Republicans/Conservative Hypocrisy?

Consider the following..."When Senator Obama's preacher thundered about racism and injustice Obama suffered smear-by-association. But when my late father -- Religious Right leader Francis Schaeffer -- denounced America and even called for the violent overthrow of the US government, he was invited to lunch with presidents Ford, Reagan and Bush, Sr."

  • The latest...Florida v. the DNC?

Have you heard the latest... http://blog.washingtonpost.com/the-trail/2007/10/0...

I'm so sick of Florida making a mockery of the election process and continually wants to hang it around the rest of the nation's neck as a albatross. They broke the rules. Ironically, other states who are voting later/abide by the rules are enjoying the results Florida sought. When they can't come up w/ a workable solution e.g. mail-in voting due to their own laws they complain and claim disenfranchisement. Gimme a break!

Who else is tired of Florida's ineptitude when it comes to managing their elections?

Why not just divide the Fl. and MI delegates evenly 50-50 between Clinton and Obama or reduce each states' delegates by 50% like the Republicans did...c'mon, if those delegates are seated there must be some form of punishment for violation of DNC rules or the DNC is nothing more than a paper tiger. What do you think?

  • Is it a 'wink, wink' to the Oil & Gas Companies...?

when Hillary rants against gas & oil companies, but has received $267,150 from them...only Guilliani and Romney has received more contributions.

What about the links to the Carlyle group? http://www.indiadaily.com/editorial/19200.asp

"Among the companies Carlyle owns are those which make equipment, vehicles and munitions for the US military, and its celebrity employees have long served an ingenious dual purpose, helping encourage investments from the very wealthy while also smoothing the path for Carlyle's defence firms."

  • In light of the behavioral patterns...?

would you call the Clintons the 'Authors of Confusion'?

    Consider...

The obvious is the Bill Clinton Adminstration where even staff members have spoken of the unfocused chaotic environment.

Hillary admitted she assembled her campaign team deliberately w/ people who had enmity towards one another for purpose of 'vigorous debate'.

And now the whole acrimonious pandemonium that is erupting in this Primary season.

Confusion breeds division. Division is encouraged because there's a beneficiary who wants power/control, while deflecting responsibility/accountability.

  • Do you agree...?

that the most important thing in this election cycle is not let ourselves be distracted by the same ole' politics that focuses and on conflict, false charges, irrelevant issues, and ultimately further tarnishes United States' image before the World Community (they're watching this process that's the cornerstome of democracy)

    Do you agree?

Let's turn down the rhetoric, push back the extremists and 'authors of confusion' on both sides of the political spectrum who are gleefully thriving on the acrimonious climate that has increasingly developed over the the course of the Election.

    C'mon, we can

  • True fighter?

Sen. Clinton has often said that she's a fighter able to take on opposition. It's interesting that every time her policies have been challenged she resorted to the 'blame game' or 'playing victim'. However, Obama has been challenged almost simultaneously by McCain, Bush, and Clinton recently and i didn't hear any complaints or whining. Obama just responded forcefully to their challenges and plead his case.

    Your opinion, please.

  • What do we learn from presidential campaigns?

    Consider the following...

"If nothing else, a presidential campaign tests a candidate's ability to think strategically and tactically and to manage a very complex organization. We have three plausible candidates remaining--Obama, Clinton and John McCain--and Obama has proved himself the best executive by far. Both the Clinton and the McCain campaigns have gone broke at crucial moments. So much for fiscal responsibility. McCain has been effective only when he runs as a guerrilla; in both 2000 and '08, he was hapless at building a coherent campaign apparatus. Clinton's sins are different: arrogance and the inability to see past loyalty to hire the best people for the job and to fire those who prove inadequate. "If nothing else, we've learned that Obama probably has the ability to put together a smooth-running Administration," said a Clinton super-delegate. "That's pretty important."

    Do you agree?
