  • More help with HOA billing screw-up?

    My Homeowners Association screws up payments and then they turn it over to a collections attorney to come after me. They misapplied a payment of $29 way back in October 2010. They received the January 2011 payment of $30 (which they now claim should be $35, but their billing states $30 quarterly for 2011). They HOA turned this over to a collections lawyer in March and I received a letter in March 201l asking for escalated payments for the year as well as lawyer fees and interest totalling $249. The collections department at the attorney office sent an e-mail to me in April stating that they had indeed received the payment for the Master Association dues as well as posting $70.25 (I guess that was the October 2010 and January 2011 payments) AND the April 2011 payment of $30. So at that point - April 2011 - all quarterly fees were paid to date. All quarterly payments were scheduled in January 2011 with auto-bill pay and each payment went out as scheduled, so the year is paid in full at this point - July and October 2011. Yesterday I received a Warrant in Debt (they had at the beginning of September put a lien on my home for the payments). The Warrant of Debt stated that I owed $148.12, pluse $68 costs, and $28.07 attorney fees, plus 6% interest from date of DOJ (whatever that means). Since all my 2010 and 2011 payments have been made I don't understand why on 9/22/2011 they would be filing for money that has already been paid. I have the confirmation numbers for all transactions and in checking with the bill pay office they confirm that all payments were made to Select Group, the HOA as scheduled. I've called the Select Group and they tell me they don't have the payments - that they were turned over to the Attorney. That makes no sense. This seems like some sort of scam, especially since they acknowledge that they DID receive all the quarterly payments - and they were paid well before the due dates. How do I answer this Warrent of Debt? It seems crazy to have to go to court in November 2011 when all the bills for the year have been paid. I am out of work and really can't afford to pay an attorney. Should I just pay the $244.19 and see where they post it?

  • can a HOA pre-charge interest?

    My Homeowners association misapplied a payment (it was made they just posted it to wrong account). We make quarterly payments of $30. In a letter they sent at the end of March they stated they were escalating the payments that were due through 12/2011. To be clear here, January 2011 payment was located by them and posted on 4/4 - 5 days after they sent the escalation letter. So I figured it was all cleared up as they had the first quarter payment. I sent the second quarter payment due by the 30th of April on April 6. So that posted on time. Thirdquarter was paid on-time in July. And I have already paid the 4th quarter as well. We should be done for the year. They claim I owe late fees and interest from April 1 to Dec. 30,2011. How can I owe LATE fees or interest if it's all paid on time?

  • Homeowners' Association turned my account over to an attorney who said I have to hire an attorney?

    My homeowner's association turned my account over to a collection agency (lawyer) because they claimed I owed past dues. I didn't and they subsequently located the payments. (Oct. 2010 for $29 and January 2011 for $30) They then escalated the 2011 payments thru Dec. 2011, which I have paid in full for the year (April, July and Oct. 2011). I requested that they remove the lien they placed on my home and they responded that I needed to hire an attorney to talk with them and would not release any information, or a payoff letter, to me, insisting upon a lawyer. A lawyer for what???? A missing $29 payment that they subsequently located? Is it legal in VA to make someone hire an attorney?

    My husband left for to indulge in a life-style that I would not tolerate. He is addicted to porn and has gay relationships. He moved out. We have not gotten a divorce, nor are we legally separated. Would I be guilty of being unfaithful or of committing adultry at this point if I met someone?
