Can a person be fired if they are are not released by their Doc at the end of their 12 wk emergency leave?
My daughter had a high risk pregnancy and had to take emergency family medical leave prior to the baby's delivery. Her 12 weeks is up on 09/24/07 but her doctor will not release her to work until 10/04/07. That is two weeks more than the FEMLA allows. Should her employer be allowed to fire her? She wants to return to work as soon as the doctor releases her.

I verified information to a law enforcement official regarding an inmate that was still under arrest but was currently an inpatient. Part of the phone conversation was overheard by another employee who complained to the HIPAA compliance officer resulting in my termination from a position that I had held for 17 years.
