  • Trying to make a Court Martial from USMC sound positive on a application. I received an honorable discharge?

    The Special Court Martial occurred sixteen years ago in March of 1997 while serving in the United States Marine Corps. I was charged with Larceny of an automobile and damage to non-military property. The original sentence handed down was a reduction in rank from E-3 to E-1, $1800.00 fine, Bad Conduct Discharge and 4 months confinement. However, the Convening Authority intervened and the charges were reduced to “wrongful appropriation” of a Motor Vehicle. The sentence that was adjudged was 30 days in military confinement and an Honorable Discharge. Had I know the severity of the consequences for my actions, I would never have taken part in using this military vehicle for recreational purposes. I remained out of trouble for the remainder of my military career and I received my Honorable Discharge from the United States Marine Corps July of 1999.

    Is there a way to explain this on a job application, to make it not sound so bad considering I still received an honorable discharge?

    The UN is developing plans for a future peace-keeping mission in Somalia and a Mission Support Concept was developed earlier this year.     AT 7:30am on April 28, Bruce went to Sally's warehouse where Sally gave Bruce an open crate containing 100 pints of strawberries. Bruce drove back to his fruit stand and put the strawberries on display. While waiting for the lunch hour rush of customers, Bruce noticed that most of his pint baskets of strawberries contained more than 15 strawberries. As Bruce knew from his college courses in Agricultural Management, the size standard for Grade A strawberries is 10-13 per pint. Accordingly, these strawberries were Grade B strawberries. At 11:45am, Bruce picked up the phone and called Sally "Take back your Grade B strawberries, they're not Grade A, you crook!" Sally mumbled about "caveat emptor" and hung up on Bruce.

    If Bruce wants to pursue a cause of action against Sally, may he bring an action in court, or is he bound to pursue Sally in an arbitration proceeding? explain.

    (Caveat Emptor means buyer beware - A buyer has a duty to protect himself)

    Bruce Buyer wishes to purchase strawberries from Sally Seller:

    Bruce faxes Sally on April 26, he offers to purchase 100 pints of strawberries at a price of $0.49 per pint.

    April 27, Sally agrees to his purchase price and states "in the event of any dispute between us, it is agreed that the dispute will be resolved not in court, but rather, by arbitration under the auspices of the American Arbitration Association."

    Shortly after receiving this fax from Sally, Bruce discovered that Robin was selling strawberries for $0.47 a pint. Bruce would now like to buy the strawberries from Robin rather than Sally.

    If Bruce refuses to buy the strawberries from Sally, will this constitiute breach of an enforceable contract? explain.
