PERJURY QUESTION?
Perjury is, alas, a very common crime in the eyes of many in the justice system. But beware: what is a lie to one person is what another just happened to see. So how do you prove perjury? Go through the elements of the crime with a practical application example.

Why must I be told that I have the right to remain silent, to an attorney, and that anything I say may be used against me before anything I say while in custody can be used against me?

Miranda v. Arizona requires that criminal defendants in custody be informed of their 5th and 6th Amendment rights before anything they say can be used against them in court. Given the aphorism that ignorance of the law is no excuse, why is this necessary?
6 AnswersLaw & Ethics6 years agoCriminal Law question about marijuana?
Te legal status and physiological effects of marijuana, does it make sense to decriminalize it, as has been done in several states? How about the classification system that lists heroin as a drug with no medical benefits, yet allows doctors to use morphine all the time?
Don't give me your gut reaction; do some research on the issues and give me a reasoned argument.
1 AnswerLaw & Ethics6 years agoCriminal Law question about stalking?
In Colorado v. Sullivan, the appellate court upheld a stalking conviction against a man who placed a GPS device on the car his wife drove, in order to track where she went. While the normal criteria for stalking were likely met, how does it impact the case if he legally owned an interest in the car he attached the device to?
Can I not attach a GPS to my car for the same purpose, at least legally? Why or why not?
What about the spouse's property rights? Consider the issues, and explain why he is or is not stalking under the facts I presented.
3 AnswersLaw & Ethics6 years agoQuestion about ObamaCare?
the Supreme Court will hear oral arguments in King v. Burwell soon. It will decide whether Obamacare's provision for subsidies for health insurance, which was drafted to allow the subsidies for state-run programs, allows the subsidies to go to people living in the 34 or so states that didn't create state programs. The national government has been providing those subsidies to about 8.8 million people, to the tune of up to 75% of their insurance premium.
These states chose not to create their own plan. Many were partisan (Republican state legislatures and/or governors), some were simply unwilling to do so. In any event, if the Supreme Court disallows these subsidies, all those people will likely lose their coverage, as they will not be able to afford their health insurance.
1. You work for the Federal government as administrator of this program. How do you plan for the possibility of the Supreme Court striking this provision down?
2. You work for the state of Pennsylvania, a large state that did not set up its own program, as state Senate President. If this goes down in flames, you will have won a political victory, but a lot of people in Pennsylvania won't have coverage, and will be REALLY cranky. The Republicans scored major wins in the 2014 elections. What are you to do, as an administrative leader of your state, to deal with the fallout of this possibility?
4 AnswersPolitics6 years agoShould mentally ill criminals be in jail?
A great deal of our prison population is made up of people suffering from mental illnesses. In the past, the mentally ill were removed from society, institutionalized for extended periods and unable to do any harm to the general populace. That was declared unconstitutional, and the mentally ill released.
What should be done with them? Present a consistent argument for your position, not just an opinion. You could even cite the Constitution, etc. in support of your position.
