Let me add more detail. A company in the U.S. is owned by the British (for example). A British citizen resides in the U.S. working for another company. Can the British owned company hire that British citizen preferentially, over other qualified employees who are U.S. citizens, IE, Americans, into managerial or any other positions? I mean, clearly if the British person living in the U.S. is the only qualified person, but aren't there laws or regulations governing this? It seems to me that the foreign owned company operating in the U.S. should give equal treatment to all applicants. Why hire someone from the home country, if someone locally is equally or more qualified? Any laws or rules on this?
