  • What are the steps i need to take regarding recent marks left all over my son by his Special Ed Teacher?

My son came home with marks, darkened severe marks, under both his arms, a scratch on his neck and his chest. All of the blood vessels were burst in his face. I went to the School District spokesperson. I met with the teacher, principal and a mediator. She stated that he hit another child, then they placed him in time out where he tantrummed and thats why his face was like that. They say they did not restrain him in any way yet restraint is the only thing that would cause the blood vessels under his skin to burst. I recently read up on Texas Legislature and it states that physical force cannot be used to place a special needs child in time out. What steps do I need to take to get this issue addressed and taken care of properly?

  • Can a lawyer keep a down payment for services if a contract was never signed?

I have only spoken to the lawyer for the initial consultation. I did not sign anything. She told me that she would need half down to open the case. I asked her if I could bring in what I have every week until I reach half down for her to get started and she said yes. I took in money still owing about $125 to reach the half down mark. 3 days later things had changed and we decided to wait until a better time to open the case. When I called for a refund, her paralegal told me that she would only give me a partial amount of what I had given her. Calling it a non refundable retainer. I was never told anything about a non refundable retainer. I never even signed a contract. I assumed that I would sign something whenever she opened the case. Is it ethical for her to keep $250 from a $750 deposit when there is nothing in writing stating any of that.

  • I was hit in an auto accident in a parking lot. Her insurance company says I'm at fault. Help!?

I was picking up my 17 year old son from school one evening. I was in the right hand lane going forward when I passed a truck stopped in the middle of both lanes. I proceeded and never left my lane. She hit me with her front right bumper in my back drivers side passenger door. I called police. They don't file a report because it is in a parking lot. I file a claim the next day (I took pictures from all angles) with her insurance company. They come and take an estimate of the damages to my vehicle. They have me send in a diagram of what happened and the other party did the same. They then call me back saying I'm at fault for making an unsafe pass on the right of her. I never left my lane at all. The pictures after the accident show that I am in my lane completely. What do I do next? The damage to my vehicle is over $1200. She dented in my back door with her front bumper. Seriously! What do I do next?

  • How to settle a personal injury case without a lawyer?

I have already sent all of my information, medical and loss wages, to the adjuster. Are there any specific questions I should be asking or any information I should be aware of to know what is fair to settle. How much should I ask for when negotiating. My doctor bills are $6,000 and I had to make arrangements for my 4 children to be taken care of while undergoing treatment 4 times a week, one of which is a baby an one is special needs. I wasnt able to even clean my house due to back pain from the wreck. I just want to know what is fair compensation. Please help me so I know what to do when they call with an offer.

  • My mother in law wants me to give her what the inurance company gives me. Is that fair?

I was rearended in my mother in laws truck. I filed with her insurance to receive chiropractic treatment under her personal injury protection (PIP). She now wants me to reimburse her for the $2500 once I settle with the other insurance company. It's not like the money came out of her pocket. Its like she wants to cash in on my injury. Is this fair of her. Should I give her that money because I got injured in her vehicle? She received way more than it cost to fix her truck from the insurance company and now she wants what I get back in medical as well. Help me out guys!
