Can they order an 18 YO to move back home because she is still in high school?
My 18 year old daughter moved out of her mom's house on her birthday, the DA is going to continue charging me child support and will go to her mother, that is not providing for her because she moved out.
Her mother also took her cellular phone and house key, she would not allow my daughter back in the house to get her stuff, as she went though my daughter's stuff and her husband would bring out one box at a time.
Anyway I have been unemployed for a long while, but still paying support, I am filing to get the support reduced and hopefully tell the judge that I am providing for my daughter and her mother and request that the support for the mother be lowered.
Can the judge deny this and force my daughter to move back into her mom's because she is still a full time student in high school.
3 AnswersFamily8 years agoMy daughter will be 18 in 10 days and wants to move out?
My daughter is in her last year of high school, she will be 18 in 10 days, I have a car for her, and I'm unemployed so she asked her mom to pay insurance for her, she said no and that she cant even park the car at her house.
She wants to move out and I will help her, but her mom says she cant because she is still responsible for her as long as she is in school and that she would need an emancipation, I told her, that once she is 18 her mom cannot stop her, that she has the right to quit school if she chose to do so.
As it stands now, on her birthday we will be going to DMV for her driving test, and the vehicle title will be transferred to her name, with insurance out of my pocket, and she will move out, the money I have been paying her mom will be going to my daughter, and well her mom will not pay anything.
I feel she is a smart kid that's just been walked on for too long by her mom, her plans are to join the armed forces next summer when school is over.
