Sabranes Oxley Act & Lawsuit?
Does the Sabranes Oxley Act of 2002 cover employees in the private sector? Also, can an employee sue a company while whistle blowing at the same? The lawsuit would be based off of reprisals he/she is suffering from due to a discrimination case by a separate employee in which he/she refused to help the company cover up the discrimination which caused the company financial loss?
1 AnswerLaw & Ethics1 decade agoCriminal Or Employer Attorney - How Do I Decide?
I am in a situation where I have been facing reprisals since a previous employee filed a civil lawsuit against the company I work for. I was coached on what to say to the Attorney from headquarters, but I told this attorney that I was already facing reprisals before the suite was settled. Now, the Supervisor who was disciplined after the company settled, has been subjecting me to unfair and harsh treatment, including loss of income and denying me a promotion which I have proof was done on purpose and that our local HR officer was in collusion with.
Now, this company is so huge and politically connected, that I don't think I could stand a 3 to 5 year civil case (yes - they drag it out as long as they can, I have seen it before). However, I have been so sick over the situation that I recently decided, maybe I should turn myself in, along with proof of my companies violating federal law in multiple states and hope for a plea bargain of some sort so that the people who have been punishing me, get punished back. It would involve multiple federal agencies though, and while I have almost 10 years of documents (most original with signatures) I don't know if this the right way or not because I don't want to do more then 1 year. I honestly am not looking to sue for compensation which most employer attorneys want to do, I would rather have these racist Managers terminated from the company and a contract given to me that I won't suffer any more reprisals. Sigghh - lost confused and not sure what do to - any help appreciate.

8 AnswersElections1 decade agoWith Stevens of Alaska Being Found Guilty?
Do you think this will just add more fuel to the fire for the Obama campaign and that more Americans will end up picking Obama over McCain? Palin was also recently found guilty f abusing her powers, now Stevens. How many corrupted Republicans need to be found guilty before the Republicans wake up and realize that the GOP has lost its way?
2 AnswersGovernment1 decade agoDo you think the GOP has lost its values?
Sarah Palin was given 150K to spend on clothing by the GOP, but her family also got new clothing. That's more then a lot of people's mortgages. I am a sickened by this, and I would expect it from Democrats, but the GOP? I mean Edwards had his 400 haircut, Hillary's 3K hair jobs. But the GOP?
I grew up Republican - I remember things that where important to America and what the GOP originally stood for. So I ask you, do you think the GOP has lost its values and morals?
20 AnswersElections1 decade agoCensorship for political reasons?
I have had several questions removed because someone who holds a different opinion about the political party I am questioning reports it as a violation.
So far, all of my questions have been re-activated, normally a few days later after no one can read them. None the less, they where re-activated.
One my last question in regards to Joe the Plumber a few days ago, I got reported and it was deleted because Yahoo claimed it was not a question. Now, I appealed, and showed where my question clearly was, and that I had even used Yahoo as my source.
For the first time I was told it was still against community guidelines and would not be re-activated.
So I emailed back asking Yahoo to please explain what guideline I had broken, since in my appeal I pointed out the question and source. Therefore I would not break the guideline in question in the future. They have never gotten back to me.
However, as a stockholder I plan to call their California Office today. 408-349-3300
SO MY QUESTION IS THIS:
Do you believe employees of Yahoo are deliberately censoring questions because of their own personal political views, regardless of independent, Republican, or Democrat.
Thank you.
5 AnswersOther - Politics & Government1 decade ago401K plan - what control do I have?
Can I get my 401 to invest into stocks I think will do well, or do I have to choose the groups they have set up for me? I am only given a few choices in my plan that I can see, and I see a lot of potential in other areas, but none of these are in any other plans. For example, Yahoo - 18 dollars a share? Yahoo is going to make some cutbacks, layoffs, and will hurt a little more, but when our Country gets out of this recession, it will shoot back up to the 30 range easily. Same goes for Home Depot, Lowes, etc. I just want to know how I can direct my 401 to invest in the companies I want them to invest in. Is it possible? If so, how?
5 AnswersPersonal Finance1 decade agoSerious Question On Debate?
OK, I was watching the debate on my Sony HD Flat Screen with a Bose Surround Sound System and I kept hearing someone snore or snort whenever Obama was talking.
In all seriousness, was it the Moderator, McCain, or an individual in the audience? I even asked my wife "Do you hear someone snoring or snorting? And she even heard it.
It could have also been someone, maybe the moderator having difficulty breathing. But does anyone know who was doing this?
5 AnswersOther - Politics & Government1 decade agoWhat if the Candidates where switched?
Actually, I have (3) Three Questions:
Who would you vote for if things where switched around? Would the country's collective point of view be different? Could racism be the culprit?
Consider, for example,
What if the Obamas had paraded five children across the stage, including a three month old infant and an unwed, pregnant teenage daughter?
What if John McCain was a former president of the Harvard Law Review?
What if Barack Obama finished fifth from the bottom of his graduating class?
What if McCain had only married once, and Obama was a divorcee?
What if Obama had met his second wife in a bar and had a long affair while he was still married?
What if Cindy McCain graduated from Harvard?
What if Obama had been a member of the Keating Five? (The Keating Five were five United States Senators accused of corruption in 1989, igniting a major political scandal as part of the larger Savings and Loan crisis of the late 1980s and early 1990s.)
What if Obama was the one who had military experience that included discipline problems and a record of crashing seven planes?
What if Obama was the one who was known to display publicly, on many occasions, a serious anger management problem?
What if Michelle Obama's family had made their money from beer distribution?
What if the Obamas had adopted a white child?
You could easily add to this list. If these questions reflected reality, do you really believe the poles would be as close as they are? Racism can do this. It can cover up, rationalize and minimize positive qualities in one candidate and emphasizes negative qualities in another when there is a color difference.
So let’s look at Educational Background:
Barack Obama:
Columbia University - B.A. Political Science with a Specialization in International Relations.
Harvard - Juris Doctor (J.D.) Magna *** Laude
Joseph Biden:

John McCain:

11 AnswersElections1 decade agoSerious Legal Question on WAMU Credit Card?
JPMorgan Chase said it was not acquiring any senior unsecured debt, subordinated debt, and preferred stock of WaMu's banks, or any assets or liabilities of the holding company, Washington Mutual Inc. JPMorgan also said it will not take on the lawsuits facing the holding company.
Now, if there is no signed credit card agreement between me and I also loss stock in WM, can I dispute my credit card debt? The problem is WAMU screwed up my account and gave me a card over the phone based on an equity loan that had been closed for over a year. When they found out the mistake, they demanded payment in full. I disputed and asked them to simply transfer to a new account and send me a credit card agreement at the same interest rate. They refused and rather then work to resolve the issue, they threatened me with fraud.
I had to retain a criminal attorney which cost almost 10K to prove the error on their part, which they eventually admitted to. However, the stress was so much that I had a heart attack and was hospitalized. So we where in the process of filing a lawsuite against WAMU for what happened and what I have suffered as they refuse to remove the dispute from my credit report.
Since then I had to retain a credit attorney (who is off today - but I did leave his office a voice mail ) and I want to know if whoever holds the new debt, if they can't prove the debt was agreed upon or there was no valid contract, can they uphold the debt and if so, can I then take the legal action against them for what I suffered?
1 AnswerCredit1 decade agoCredit Card Agreement?
Ok long but need help. I had an equity loan in Florida that was paid three years ago with WAMU. Last year I called to inquire about a credit card so I could start my own business. The operator told me I was already approved at 4.7 for 150K. I said great. They sent me a credit card, with no credit card agreement. I used about 38K to start my business, and was making my payments on time perfectly.
Then 3 months later, I get a letter stating I needed flood insurance on my home. I called and asked why because I live in the Mountains. They told me it was for my home in FL. I told them I sold that home and hey freaked out on me and demanded payment in full at once. They said they gave me the card based on the equity in the home, and it was an equity card, not a credit card. I told them the equity loan was paid in full at time of sale, and account was closed. How could they do this?
They started to accuse me of fraud and said they would be contacting authorities. I told them, why not just switch the account over to a credit card and simply work things out this way. They refused and told me they would be seeking criminal charges.
This freaks me out, I had to hire a criminal attorney for the first time in my life (which by the way, a good criminal attorney won't even talk to you for under 5K). Then I had to hire a credit attorney on top of that. All this stress caused me to have a heart attack and put me in the hospital.
Finally WAMU admitted it was there error because they could not show any credit agreement in writing or verbally, so they offered to work out a payment plan. But by this time, because of my heart attack, and the attorney fees, my company went under, and I was broke so I decided to declare bankruptcy. I litterally just finished my credit counseling two weeks ago and awaiting my certificate. And my attorney was planning to file a law suite against WAMU for what they put me through.
Now WAMU was seized by the FDIC, then purchased by JPMorgan. So, my quesiton is this. Since I can't sue WAMU now, and JPMorgan won't be able to provide a credit card agreement in writing or verbally or even verify the purchases because WAMU could only provide 1 for 800 dollars, can I have it dismissed? Should I go back to the credit attorney or deal continue to deal with the attorney who was preparing the law suite?
I have all documents of communication between WAMU and my attorneys, and while this has been going on they still hit my credit score and have collection companies call me. Each time a collection company calls, I give them the name and phone number of my credit attorney and then they don't call back. But like a month later, another collection company does. Suggestions - who should handle this and will I have the option to sue anyone for their errors?
2 AnswersCredit1 decade agoWould you call me a Liberal, Democrat, or Republican?
Please star this question, as when all the answers are in, I will tell you what I am. However, I want to know what most members on Yahoo would consider me.
I believe in Pro Life, but think a woman should have a choice because it is their body.
I believe in smaller government but I think we need more regulations with severe penalties for those who break those regulations..
I believe the economy has been in a recession for months and heading towards a depression.
I believe we where lied on purpose about the war in Iraq and we should pull out our troops.
I believe in spanking a child as a form of discipline.
I believe prayer should be done at home and not in school.
I believe no one in our Country should go to bed at night hungry because they can't afford food.
I believe in God
I believe homosexuals have a right to marriage, but I don't approve of homosexual activity because I see denying them that right as a form or discrimination.
I believe in the Constitution of the United States
I am a member of the NRA
I am a member of the ACLU
I served my Country during Storm and attended Canoe U (If your are military, you know which school!)
I believe in dialogue before war and that I shouldn't force others to conform to my demands so we can discuss our differences.
I have two daughters, both are bhuddists and so is my wife.
I am Catholic
I am in an inter-racial marriage
We cut coupons, and in the last year have become very frugal
Both my daughters are in private school
Rather then give a person begging for money for food, I offer to get them food - sadly, 90% of the time that offer is rejected.
I believe McCain is a bad choice for America and hasn't offered any real answers facing the problems that plague our Country.
I believe Obama is also a bad choice and hasn't offered any real answers facing the problems that plague our Country.
I don't "tolerate" other religions, I "respect" other religions.
I think everyone should pay the exact same percent on their taxes, regardless of what their pay is, ergo if tax percent is 10% on 100K = 10K. On 10K = 1K.
I believe all our children should be covered medically
I believe Social Security will be gone by the time I am old enough to collect.
I believe this bail out is the mistake of the both banks, insurance companies, wall street, and my fellow Americans.
I believe it is my responsiblility to help those in need, which includes paying for welfare, food stamps, and medicaid with tax dollars.
I believe we need tighter regulation to prevent the fraud that takes place in our welfare system so it is used for those who actually need it.
So what would you call me? Liberal, Democrat, or Republican? I have been registered since I was 18.
24 AnswersElections1 decade agoMcCain or Ron Paul on Economy? Which idea do you prefer?
McCain wants to make another agency to keep an eye on the economy if he becomes President. Ron Paul, claims the current proposal is a mistake. Which one do you think is correct?
Ron Paul

McCain on New Agency

So I have three questions.
Whose idea do you agree with?
Do you think we need another government agency?
And isn't the Republican agenda to make smaller government or did that change?
I do not approve of my tax money bailing out big companies esepcially when their upper management is still getting millions of dollars in bonus.
Perfect example is WAMU - if CEO makes it through, he gets 9 million bonus.

21 AnswersElections1 decade agoRecruiting Company in Japan for Americans?
Does anyone know of a list of Job Recruiting Companies in Japan that specialize in hiring Americans?
1 AnswerJapan1 decade agoTaxation without Representation?
Today GW and the brain children decide once again to use our tax dollars to bail out big corporations rather then help everyday Americans. Even McCain and Obama are not in favor of this.
To quote source:
http://biz.yahoo.com/ap/080919/financial_meltdown....
President Bush, flanked by Treasury Secretary Henry Paulson and Federal Reserve Chairman Ben Bernanke, acknowledged that the program will put a "significant amount of taxpayers' money on the line."
Why should my tax money be allowed for this? Where is our representation here? Do you think these bailouts should be allowed?
My personal thoughts are this, if we continue to bail out banks and financial institutions everytime, then they will continue to take risks because they know there are no consequences for their actions.
I would rather see major corrupt banks go under, then have my tax money wasted on bailing them out. Does anyone else think this way?
15 AnswersElections1 decade agoPalins personal email account for official Government Business?
First, I would like to state I do not approve that a persons personal email attack was hacked and think that is a severe violation of privacy. However, Governor Palin, just like GW used her personal yahoo email account to conduct official business so there would be no record of it. My sources:
http://blog.wired.com/27bstroke6/2008/09/group-pos...
http://politicalticker.blogs.cnn.com/
So my question is this, do you think Governor Palin and other members of our Government should be allowed to use their personal email accounts for official business?
Personally, I think using her personal Yahoo email account to conduct official government business is a violation of public record laws and it is shows how Palin, McCain are just like Bush and Cheney. These Public Record Laws are there for a reason and no one should be above the law!
There should be some form of punishment for this! This is why I encourage everyone to vote for Ron Paul! What do you think?
If McCain and Palin try and dance out of this one, then I will do more then vote for Ron Paul - I will change my party affiliation to independent.

Bush attacked McCain on his war record, his marriage, his votes, and did a complete character assassination.
Now Bush supports McCain, and McCain supports Bush. Yet, McCain is now resorting to the same Rove style tactics that McCain called shameful and disgusting.
This is what is wrong with the Republican Party - they don't care about America anymore only about themselves. So my question is this, do you remember Bush attacking McCain? If so, how do you feel about Bush now and why didn't you push for McCain in 2001?
