  • benefits for a child through a disabled parent and step parent?

    The rules say that a child can receive axillary benefits from a parent or step parent that is disabled and also state they will receive a portion per family. Does this mean that a child can receive a benefit from a disabled father and also a disabled step father since they are 2 different families. I am asking because my daughter has been receiving from both her father and step father. We have been saving her step fathers benefit in fear that they will ask for a refund of the money. But then someone told us since we are 2 separate families she is entitle to the benefits.

  • The ER did not catch my husbands broken hip?

    My husband feel a couple weeks ago, he could not get up was in terrible pain in his hip. We called the ambulance he was taken to the ER. He was taken to xray which showed nothing. He was is so much pain he was to the point of yelling with each movement it was all in hip area. Instead of looking further into this he was sent home. Could not move for 2 days , we took him to another er where the immediatly did an ct and found a broken hip, by this time it had been 48 hrs after the injury and he developed pneumonia and was hospitalized for a week. What recouse do we have as this er dr did not persue and caused my husband to suffer and and additioanl trauma

  • Will my childs Social Securty Disability payments stop now that she lives with me?

    Our daughter has always went to school in my ex husband school district until this year and now have move in with me and and is now going to school here. I am total responsible for all her school fee, clothing and all other expenses related to raising her. He does not help out financialy at all. My question is he is still receiving a social security disability check in the amount of $536.00 per month for her when she is not living there and does not spend any of this on her or give me any help. Does anyone know if I can get this check transfered to my address for her or get it stopped completly since getting the check and not spending it on her is fraud.

  • Court summons without a court date?

    I receiced a sherriff summons with a complaint attached. I have 20 days to respond to the complaint. This is for an old credit card debt that was incurred in 2002 and the last payment was made 2006 so it is not past the SOL until next year. There is NO court date set , only telling me to respond to the summons. So I am wondering if this is just a summons to reply and not a judgement summons. I have written a letter explaining that I have never received any billings from this collector and was not aware this debt was still unpaid. I went through a divorce in 2005 and this is a debt left over from that. I want to get this taken care of , so in my letter I put a repayment plan that I could comfortably afford with no problem and I also made a settlement offer. I am going to hand deliver this letter to the court house on Monday. Am I right in asking the court for a repayment plan or settlement offer at this junction? and once the court receives my letter will a court date be set or will the Judge just rule from my response? The company suing me is in another state. Sorry so long but wanted to get the point across. Also in asking for a repayment plan should I still be worried about bank accounts being froze? I am remarried now and have a joint account, I am wondering if I should have my name taken off the account until this get settled> Any advise is appreciated..thanks

  • How to respond to a subpoena?

    When I got home there was a subpeona left in my door stating I was being sued for a credit card debt that was opened in 2002. There is no court date set and only states that I have 20 days to respond. How do I do this? Do I respond to the court or to the company suing. This is an old credit card debt from a previous marriage. The company that now owns it accquied it in 2009 but I have never received and billings or paperwork from them regarding this debt.     I share custody with my ex. our daughter is 13 and wints to come live with me full time. We all 3 sat down and she told her father her wishes, he responded with whatever she wants to do. After our meeting she wrote a letter to the judge telling him she told her mom and dad want she wants to do We are going to court tomorrow and today I find out his attorney told her to sign a piece of paper that she thought said her mom gave her a piece of paper and she willingly wrote the letter and mailed it. Should I be worried? What if the paper says she did not willingly write the letter? She is going to be in court with us tomorrow to tell the judge in person what her wishes are. I am sure it can be good since it comes from his attorney. She did say it was just her and the attorney alone in a room when she was asked to sign the letter
