2 AnswersEconomics9 years agoWe all have human rights one of which is to be presumed innocent until proven guilty, how can someone accused?
prove that they were not speeding? With allegations such as speeding or any other traffic matter it is classed as a summary offence and therefore their is no right to a jury. The Judge is not law trained and the police have no evidence to offer except that of their word. The device is their word and the devices used have many defects dependant on the operators use. A home office spokeswoman< the Assocuiation of Chief Police Officers (ACPO) and the Police Scientific Development Branch (PDSB) have laid down guidelines all of which have one common factor and that is that the device is only as reliable as the operator. I aid people in speeding offences for free as it is hard to prove you were not speeding if it was in fact you in the car and you agree you were on the road at the time and you were the person stopped for the offence. So why is it the word of one man should be taken over another, this obviously leads to many injustices, unless of course you are part of their system or can afford some £3000 to get representation?
Anyone accused of these offences can contact me directly by email or add me as a friend and i will be happy to help?

5 AnswersLaw & Ethics9 years agoIn Law it is stated that a person is presumed innocent until proven guilty beyond reasonable doubt!?
What amounts to reasonable doubt?
Look at Traffic Offences, speeding for instance. A man is accused of travelling 40mph on a 30mph Road and he protests he was travelling 30mph. The evidence against him is a speed device operated by a Police officer who has first formed the opinion he was speeding as is required by ACPO.
Can you believe beyond reasonable doubt that an officer can tell the difference between 30 and 40 from a distance?
The officer then operates the device and records the speed, yet despite the device recording the information on a data logger, no other evidence is introduced other than the word of the officer, this does leave the system open to abuse, by a minority of officers and therefore is that not reasonable doubt in any of these circumstances?

Which one picks it up?
5 AnswersRenting & Real Estate9 years agoDo people agree that there is a conflict of interest when say the manufacturer of a speed device who sells it?
to the police, is responsible for testing it and saying it works fine. This would be in effect like me giving my own car an MOT
