  • Can past due HOA judgment/bank garnishment be discharged in Ch. 7 bankruptcy if I am trying to keep home?

    My HOA's Attorney raked up excessive unjustified fees on me for their own personal gain. I was late paying my HOA fees initially and willing paid the stated late fees along with my HOA dues. However, the Attorney collecting these fees does not accept credit card payments over the phone or online, etc. Therefore, I mailed the amount owed. To my surprise, I later received another letter indicating I owed another $200 for late fees. I ignored this notice b/c I thought that they probably didn't input my payment in their system prior to the letter going out. So I received another letter stating I owed the $200 plus additional fees, and so on. Basically, each time I paid the stated late fees via mail, the Attorney claimed my payment didn't arrive on time to their Office, and therefore I owed additional late fees.

    In addition, all of my payments were applied towards Attorney late fees rather than my HOA dues. My dues were only $440 per year, but within that year I paid over $900 in additional fees that were never applied towards the full amount owed to my HOA. The Attorney continued to take their money off the top and say that I still owed a balance towards my HOA dues. As a result, I stopped paying b/c I felt I was being ripped off and the fees continued to increase. They ended up suing me for the amount they claimed I owed along with more Attorney fees and court cost.

    Since I mistakenly missed the initial court date, when I showed up for the second court date where they filed a judgment against me, they won simply b/c I missed the initial court date. Now they are garnishing my bank account for the amount owed from the judgment.

    Currently, I'm unemployed and my home is in foreclosure. I recently filed chapter 7 bankruptcy to stop the sale of my home so I can have time to secure a job and work out a modification on my home loan and get it out of foreclosure. I have not had the meeting of creditor's as of yet. Can I discharge the past due HOA fees from the judgment/garnishment? I am willing to pay the past due HOA fees I accumulated after the garnishment since I intend on keeping my property. Also, I live in Georgia. Thanks for your answers.

  • How can I change my kids last name without bio dads consent?

    My kids father changed his last name legally w/out informing me or his children. We were married and divorced in California and I have sole physical and legal custody. I currently live in Georgia. I attempted to have their last name changed to my maiden name, which I use. However, in Georgia I need bio dads consent eventhough he doesn't have legal/physical custody. Is there anyway around this?

    I don't want my children to have a last name that neither of their parents have, but their dad refuses to consent to them having my last name. Once I found out from a friend that he changed his last name months prior, he stated he wanted to change our kids last name to his new name too. However, I don't believe him b/c he never even told me or our kids that he was planning on having his name changed. I had to call him to find out the truth months after everything was finalized.

    Their father still lives in California and he rarely visits or speaks to them over the phone. The same behavior occured when we all lived in California approximately 20-minutes away. I bring the kids to California to visit every summer and he never spends more than 3-days with them out of the 2-weeks that we are there. At the most, they may have an over night visit w/him 1 night out of all that time. I encourage him to spend more time, but everything else he has going on seems more important. He will not give me his address, and uses a PO Box when he does send something in the mail. He always sends money to care for our children each month, but he has never paid the court ordered amount. He simply gives whatever amount he wants to. When I took him to court, he quit his job so that he wouldn't have to pay the stated amount. Since then I've left the situation alone. Whenever he wants to see or talk to the children I allow it, and I accept whatever amount he chooses to give without filing any legal complaint. Therefore, under the circumstances I feel he should consent to them having my last name. I think he is being so selffish about our kids name by not allowing them to have my last name. If they can't have his new name they have to remain with his old name until they turn 18. When I list on school documents and stuff the names of their parents, it will appear as though they are adopted b/c we all have different last names.

    Their father's reason for changing his name was b/c he believes it is cursed due to the meaning of the name, his unsuccessful life, and his father's side of the family. So he came up with a crazy last name for himself that has a worse meaning than his original last name. My last name, however has a strong positive meaning. I looked up the meanings of all of our last names since he stated that was his reason. He doesn't want them having my last name b/c I'm a woman and he says he's the head of them. Well, from his behavior it's hard to tell that he's even the father. At any rate, is there anyway around getting his consent? Can I file for the name change in California since that is where we were married, divorced, legal/physical custody was determined, and our children were born? Our kids deserve to have at least one of their parents last names, this mess is crazy.

  • How can I find out if my 12 year old son's botched circumcision as an infant caused his penis not to grow?

    My son was born premature by 1-month weighing 5 lbs and 2 ounces. As a result, the doctor waited 1-month prior to performing his circumcision. At first my husband was present during the procedure, but eventually left the room b/c he claimed he was unable to stand the sight. Therefore, no one was present except the doctor and nurse. Everything seemed fine when we left the doctor's office and they didn’t indicate that anything went wrong, although I didn’t actually look at his penis at that time. However, approximately 4-hours later when I started to change my son's diaper I saw that it was completely soaked with blood. It was so bad that my husband rushed home and we took him to the emergency room immediately.

    I forgot what the doctor at the hospital said exactly, but he made it seem like everything was fine and it was a minor cut that would stop bleeding in a few days, and he showed my husband how to care for it. I did ask was this normal and he said some babies bleed a little after being circumcised. To be honest, I felt that the doctor was holding back from revealing that this amount of bleeding was abnormal as a professional courtesy to the doctor who performed the circumcision. I suspected that he didn’t want to cause a potential lawsuit unnecessarily. The situation didn't sit well with me and every mother I spoke to said they never heard of anything like that happening before. My son bled for approximately 2-weeks although it lessened by the day. I was so disturbed by the sight of it that my mother and husband had to change his diaper for those 2-weeks. However, my son never had a fever or cried from pain during those 2-weeks, nor did his penis look abnormal once it healed. So I let the incident go against my gut feeling.

    My son is now 12-years old and his penis is still the size it was as an infant. Ordinarily I wouldn't be concerned but his father is very large and so is his older and younger brother. Initially, it was noticed that my son’s penis was very large for an infant, but it has remained about that same size ever since then. How can a penis start out very large compared to other infants, but not continue to grow over time? His brother is 2 1/2 years younger, but his penis has been larger since he was about 3 and my other son age 5. I know this has to be disturbing to my older son although he doesn't say anything about it. In addition, I've seen my younger son get an erection on many occasions such as, waking up in the morning, but never have I once even thought that my older son has had an erection.

    Over the last year he's been hiding his private part, which I know is probably normal for his age. However, when I've accidentally seen it I noticed it still remains the same. I was hoping he was just a late bloomer, but my gut feeling tells me it's something more. Over the years I've been concerned but I was trying to give it time to grow and develop, plus I really didn't know how to approach the situation. I have not said anything to my son about this b/c I don't want him to feel more self-conscious than he already does.

    For my son's sake I want to have him examined or something to see if everything down there is working properly. This is the age when he starts showing interest in girls, although I don't want him having sex. I don't want this issue to be viewed as a problem for him b/c he has many other concerns working against him right now. He's in the 7th grade currently and is younger than his grade level peers b/c he was skipped. He is also shorter than his peer’s b/c his father is only 5' 4". He's been the target of bullying since 1st grade. In addition, he has a lisp that has become very noticeable recently, a temporary crown in the front of his mouth that is discolored, and diagnosed with ADD which negatively affects him in school. All of these factors contribute to him having low self-esteem. I don't want him to realize sooner or later that something is wrong with his penis and feel even worse about himself.

    Has too much time passed for me to do anything legally? How can I prove that the circumcision is the reason his penis is small and possibly won't get erect? Can anything be done medically and/or cosmetically to increase his size at this age, like a penis implant? I know this may sound strange for a mother to be so concerned about her son's private area, but I feel so guilty not having pursued this problem legally and medically years ago when my gut feeling kept telling me there was a problem all along. Also, I don't want this to add to his existing problems. What can I do to help my son or even find out if there really is a problem? What kind of attorney and doctor would I seek? Thanks in advance for any advice concerning this matter.

  • Do I need the bio dad consent 2 change kids last name 2 my maiden name?

    Dad recently changed his last name legally without informing me or kids b/c he thinks his bio name is cursed. He is against them having my name but wants 2 change their name 2 his new name that has no bio/generational connection.We got married/divorced n CA, kids & I now live in GA.I hav sole legal/phy custody.If we don't agree on name change do kids hav 2 keep current name that neither parent now has? Now everything is messed up b/c the dads name on birth certificate doesn't match dads current name. Can I change dads name on kids b-cert? If kids keep his old name it will look like they r adopted b/c we all have diff last names. Can a judge grant their name change to mine so they will b legally connected by name 2 atleast 1 parent even if it's against dads will under these circumstances? Is there anything I can do? My kids should have 1 of their parents last name and I hate dads new name. They should not have 2 keep dads old name til they turn 18.
