DUI In Riverside, CA?
My brother got pulled over because he was diving a car that matched the description of a robbery suspect. After making him back out of the car with their guns drawn, go to his knees, etc. They realized he was not the suspect but he had been drinking. They gave him a field test, decided to take him in. He was told at the jail that the breathalyzer was not working so he did a blood test. I do not know the results of the test. He is over 21, has no priors for anything, was not speeding, swerving, Etc. Just in the wrong place at the wrong time, and yes, HE PROBABLY SHOULD NOT HAVE BEEN DRIVING. So my question is, what is he looking at as far as jail, fines, etc. Does he have any viable defense for probable cause? I hope to hear from knowledgeable lawyers, LEO's, and people with similar situations. I know I will hear from other trolls, and they are always funny to read too, so knock yourself out trolls!
Thanks
4 AnswersLaw Enforcement & Police1 decade agoWhy did B of A cancel all my accounts?
I have had a business checking and several other accounts with B of A for about 4 years for my small business. I have "never" bounced a check or been overdrawn, not even close. I haven't even had any NSF checks that I deposited. I have checked the credit bureau's and all is fine. But they sent me a letter saying they were closing all of my accounts, including my savings account and CC account (non business related) which I've had for 13years.. When I called they said sorry but we won't tell me why, because we don't have to. And I repeat, I have never ever bounced a check or been overdrawn or I wouldn't ask this question because the answer would be obvious. It is a major pain to scramble for a new business checking account, and frustrating that they refuse to even tell me why they voted me off the island. Any clues? Other than B of A sux?

1 AnswerSmall Business1 decade agoHow much jail time will this criminal get in CA ?
5 counts of 211-212.5(c), 5 counts of 422 PC, and 3 counts of 459-460(b) and is currently On probation for M459 & M484G(A
This person is accused, and was arrested for 3 different robberies, on 3 different days. (I assume the extra 211 & 422 are for each item taken?) . The evidence in at least one of the robberies is strong, (caught on security video). I know there may be some plea bargaining, and some counts may be dropped. He has also yet to be a arraigned on for a PC 664/211 in a different county (I guess they will do that while he is still in jail in the other county)
I am hoping they go away for a long time, but people have told me he may only do 6 months or so since he may get concurrent sentences for the 3 robberies (and 1 attempted robbery) ?
Can this be true? Is our justice system that really lame?
Will any and/or all of these be considered "strikes" in CA if he is convicted ?
