Did I receive a bogus citation that will be dismissed on a technicality (in California)?
Facts: I was exiting the freeway on an offramp with 2 left turn lanes near Riverside, CA. Just ahead was a 3rd lane for right turns. I entered the shoulder so that I could get to that 3rd lane and turn right without waiting for the other cars waiting to turn left.
I received a citation from the CHP and the officer wrote "Passing on the Shoulder" with the charge being "VC21755". Online, my citation reads "VC21755-Unsafe Pass-Right Shoulder" The California DMV VC21755 states:
Pass on Right Safely
The driver of a motor vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. In no event shall such movement be made by driving off the paved or main-traveled portion of the roadway.
My ticket states that I was going 5MPH and the officer put a line through the box that indicated "Safety" in a manner that is was not applicable.
VC 21754 states that I can pass on the right if the car(s) being passed are turning left.
