I Just won an eviction hearing, what's next?
First time landlord here. They failed to pay (1st month rent) and I filed a Summary Ejectment and won the case. I won a monetary case for $1669 (1 month plus pro-rate december plus court fees) and a case to seize the property. Judge said we have until the 26th to either come to an agreement for them to stay, or they have to turn the keys over on the 26th.
My question is two parts:
1. When and how do they owe the monetary amount awarded? What do I do if they don't pay it? Go back to court? Hire a collection agency? Call the Sherrifs? How long do I wait?
2. Assuming I don't agree to let them stay by the 26th, what happens then? What if they don't move out willingly? Call the sherrifs? back to court?
Thanks everyone in advance. The last time I asked a question before the hearing you all were extremely helpful.
2 AnswersLaw & Ethics7 years agoDo I need to wait to evict if A. Rent check never cleared and B. Renter has never technically signed lease?
I'm a new landlord and decided to rent to a couple. I went against advice of others and picked a couple with poor credit, but a so called good history of rental payments. First check bounced and they were moving in before even providing a deposit. So far I've received $0 and they've been living there over a week. We signed a lease, however; I've yet to provide them a copy. If I were to take this to the sherifs, could they eject the persons from the house without waiting to go through court? I know the persons cannot produce a lease, and no money has ever cleared my account. Technically, are they just squatting?
I'm so far heading down the path to giving them a chance to pay everything in full, but already they're acting like they might have to pay in installments. The nightmare is just increasing. Yes it's my fault but should I just evict them now and will it be quick? Or either way would this need to see a judge?
Also I'm sure there's terrible legal consequences to withholding a lease copy, but here we are. Facts remain that I could make it disappear if that makes me a bad person or not, legal or illegal.
Thanks for the answers!
11 AnswersRenting & Real Estate7 years agoWhen do lawn timmers and weed eaters go on sale at Lowes?
I have to imagine there's a point in time when these items are reduced in price to clear out for the end of the season. I'm in NC so I don't know if that makes a difference. Do you usually see price drops on these items or seasonal sales? Patio furniture, for instance drops in price by July/August. Anyone?
