What is the statute of limitations for homeowner insur. reimbursement for an injury at a client's SFR home?
I'm a real estate appraiser, and I was walking from the street, across the mowed lawn to the sidewalk of a house I was going to appraise. The lawn looked perfect, and nothing was visible--but there was a 3" hole deep, and was about 6" around circle that I stepped into. I went flying and I ended up fracturing my ankle in 3 places. Two neighbors were so helpful with ice and to borrow a walker for the afternoon. After inspecting the house, I brought the wife out to the hole in the lawn and she could not spot it easily either, but then did identify where it was and noted that it was bad. I told her to fill in the hole and then no one else will get hurt on it. I later came back to take photos and they followed my suggestion, and I photographed the dirt circle where the big hole was.
I just crossed 5 months, and I've incurred about $3000 out of pocket expenses relating to my ankle, and I'd like to ask the homeowner to file a claim with their insurance company. I do not know if I will need surgery, I'm letting it continue to heal and I will know probably in another 4 months if I can heal well enough or if I need to go in for an operation.
What is the statute of limitations time period on this kind of thing? I do not want to give them a final figure yet until more time passes. I do, however, want to write an official letter indicating that I would like reimbursement processes to begin, and to reiterate the injury and make them aware that it was a fracture.
How should I proceed?
