  • Can I sue a doctor for an insurance mistake?

Last year, my doctor advised me that my IUD would not be covered by my insurance. I took her word for it and subsequently paid $700 for the IUD. Recently, one of my co-workers got the same IUD and it was covered by the insurance. I called my insurance company and they told me that it is in fact covered, but the doctor never submitted a claim. Since it is more than 60 days, the insurance company says it is too late for me to file a claim. Can I sue my doctor for reimbursement of the money I paid since she gave me incorrect information and failed to file a claim with my insurance company?

  • Tentant won't remove property from yard?

I own a 2 family home which I live in 1 of the units. The tenant has left property in the yard and I want it removed. I have asked that he remove it on several occasions and he ignores my requests. There are several empty buckets and milk crates and they make the yard look disgusting. Can I legally remove these items. The lease states that the yard must be keep clean.

  • If a customer doesn't pay, can I take the materials back?

I am in the pool cleaning and maintenance business in the state of NY. I have a customer with a balance of almost $1000 who refuses to pay. I am planning on referring the balance to a collection agency, but it is doubtful I will be able to collect. Can I go on the customers property and take back the pump and other parts that I installed?

  • What do I do if I was threatened by another business for taking customers?

I recently started a new company in NY. I am just starting out and the owner of another company, a competitor, showed up at my first job site and threatened me for taking his customers. I worked for his company last year and learned the business and he now found out that I decided to go into business for myself. What should I do to protect myself?

  • What recourse do I have against former tenants?

The former tenants in my rental unit left the place a complete mess. I have filed a small claims lawsuit to sue for cleaning charges using the industry standard fees. I did most of the cleaning myself, however I do have a receipt for a painter that I hired. Do I have a case? Security deposit was used to cover the unpaid rent.

  • Can I be arrested based on a neighbor's accusation?

My next door neighbor has accussed me of trying to poison his dogs. The other day I had a police officer knock on my door to tell me the neighbor called and is filing an incident report to have on file. He had a zip lock bag full of rat poison that he showed me which was apparantly found in the neighbors yard next to the fence between our properties. The police offer put my name and date of birth in the report and said the neighbor told him I have threatened to kill his dogs which is not true. I have exchanged words with the neighbor in the past about the dogs' constant barking and filed a complaint with the town, but I did not try to poison his dogs. Is it possible for him press charges and have me arrested for this?

  • What to do about a tenants dog?

I recently had a new tenant move in and they brought a dog. I have a private house and they rent the second floor. The lease clearly states that the dog is not to go to the bathroom or be walked anywhere on the property. They openly allow the dog to roam the yard and go to the bathroom all over the place and do not clean it. There is poo all over the place. I confroted the tenant and she said too bad, she's not walking the dog in the mornings in her pajamas. These tenants have been here only 2 weeks and they make a lot of noise and wake me everyday at 5:30 in the morning. I have already told them to find a new place. Is there anything I can do about the dog situation? The crap smells horrible and looks disgusting all over the year.
