  • Attorneys: Possible Harassment?

    Situation: A person lives in a townhouse that has an association. The president of that association has done the following...

    (1) selectively enforced rules against certain people, but not against all, [He is trying to fine a resident for having an empty flower pot on the deck when the next door neighbor also has empty flower pots but is not getting fined]

    (2) Has violated the covenant of the association himself without retribution [hung window treatments that are not white on the exterior],

    (3) has created new rules and tried to retroactively enforce them [original rules said that TV dish is OK, but he changed that rule and is trying to fine people with a dish]. This was also done against the same person in #1.

    (4) is raising association fees beyond the limits as set forth in their association by-laws,

    (5) is borrowing money in the name of the association for unapproved projects. The amount borrowed is beyond limits set aside for unapproved projects.

    (6) Has sent numerous other threatening emails pertaining to what he perceives has violations (but are not "approved" violations through voting) to the person in #1 and #3, but not to all people possibly guilty of the violation.

    Question: Can this person sue the president of the association personally as well as the association as an entity for harassment? Are there any legal actions that can be taken to prevent this harassment? Can the police be brought it to make this a legal as well as civil matter?
