  • Can a California Hospital terminate you 3 days after you give a resignation letter that was dated and timed?

I am a Registered Nurse in California that works in a Hospital. I turned in a dated and timed letter of resignation stating that it was effective immediately. Today, I received a letter from the hospital stating that they reject my resignation and are terminating me for violations of Hospital policy. The letter is dated three business days AFTER my letter of resignation.

I spoke with my Union Representative regarding this matter however she doesn't seem to want "create waves" with the hospital administration. She did speak with the Director of HR and he said the letter was sent out by mistake. When I asked my Union Rep for a letter from the hospital (on hospital letterhead) stating that I did resign, she stated that she wasn't sure if the hospital would agree to do this. I'm getting the feeling that the Union Rep that I'm dealing with isn't being honest with me and in fact didn't speak with the Director at all. I plan on contacting the Director of HR myself, however I wanted a little more information/opinions on what to discuss with him.

If anyone could please provide me with some info, I would GREATLY appreciate it.

    - Does anyone know if a CA employer/hospital can reject a resignation and terminate you instead?

    - If this is legal, is there a website that I can refer to that states that this is legal?

  • Am I responsible for a dog attack on my property?

I live in California and own a female pit bull that is 11 years old (human years). She has never bit another dog, but she has barked at other dogs that get aggressive with her. Our backyard has a chain linked fence to our neighbors back yard where they have a dog as well. Today the neighbor brought me a vet bill for an incident that occurred 2 1/2 weeks ago.

According to the neighbors story our pit bull was aggressively barking with their dog which is a collie breed. From what the neighbor said, our pit bull bit off a toe of the collie's paw. The collie was taken to the vet and required surgery.

I was home during this supposed incident and did not hear any aggressive barking that day. The neighbor did not approach me or knock on my door the day of the incident or within that week. There is ALWAYS somebody home and we would have known if the neighbor did come to the door and informed us of what had happened.

Our dog has never attacked another dog. In order for her to have bitten the collie, the collie would have had her paws through the chain linked fence on our property.

Now that two and a half weeks have passed by, we our bearly learning of what happened and are now

being presented with a vet bill. Because we feel like its our word against theirs, what can we do?
