I am having trouble with a neighbor who has property next to mine, that had his property just surveyed, the surveyor marked the approximate line of ownership but was about 12 feet off from the corner of the land owners property. The property owner asked the surveyor if it was alright to leave the survey stake temporarily where it is. The surveyor said ok but when you build the fence you will have to move back from the road right of way. Well the property owner did not move it back. The owner is building the fence and claiming the county road right of way. I would like for a TX surveyor to advice me on what I need to do to correct this problem, as this other owner is taking 25 or 30 feet of said county road that he states he bought from the State of Texas. The county judge says that when 2 different owners have property next to each-other a road that is not been used for 10 years is to be divided equally. He will not show paperwork showing that he owns that road. I have contacted the county clerk and she says that she does not have paperwork showing in her office that the State of Texas surveying said property. Also the county tax attorney says that this other owner is to pay for his part of the surveying along with me paying my half. This other owner refuses. Also I would like for a Texas attorney to advice me also on this matter.
