  • I'm dual miltary and my ex refuses to divorce me because he gets bah. Is this fraud?

    He is a corpsman on shore duty and I am actually on a ship, technically on sea duty, although I'm in RCOH.

    I left him in march 2011 and have been trying to get divorced ever since. The law in VA is you can get divorced after 6 months with a separation agreement (which of course he didn't agree to, even though I'm asking for nothing), OR 1 year separation, no agreement needed. But he would still have the ability to contest.

    I am actually NOT recieving BAH, it was taken from me right after I got to my ship- I was told I needed to "re-apply", I never ended up doing it because I ended up leaving him.

    He has NO reason to be contesting this divorce. It's been well over a year- what I'm wondering is is that BAH fraud?

    I feel like it is because that is money he is making in order to pay for "in town" expenses- being how we aren't "together/married" anymore, I feel he's not entitled to that.

    I called up his command a million times to try to get him pushed a bit to finalize the divorce, the keep ignoring me and saying"oh it's a civil matter". Yeah I get that, but it's in their/the navy's best intesrest to help me out with this since they're paying him extra for a marriage that is no longer.

    Any advice on what routes to take to get this resolved? Should I call the CO? I'm really desperate here, I feel like the system is NOT working fast enough!!!!!!!!!
