  • Determining legal age differences?

    I asked this a couple weeks ago for a paper I'm working on. Below is a federal statutory rape provision:

    Whoever knowingly engages in a sexual act with another person who—

    (1) has attained the age of 12 years but has not attained the age of 16 years; and

    (2) is at least four years younger than the person so engaging;

    I was wondering whether part 2 means exactly 4 years younger (48 months) or just being four years younger in age (a 19 yr old and a 15 year old) but not exactly 48 months younger. So for instance, does part 2 apply to a 15 and 19 year old couple who are, for example, 3 years and 4 months in age difference? If you have a source that would be great.
