  • for mutal divorce can I an make agreement that the child custody will come to me(father) after 2 years?

the mother want to keep the custody of the male child with her. I want the custody of the child come to me. mother is staying in India at present and I am staying in USA. I want the child to come to USA with me and study there. I and the child are USA citizen. I am now negotiating with them for mutual divorce. but when I said the the agreement for mutual divorce should have a clause that after two years when the child will be 7 years of age the custody should come to me. but the wife advocate is saying we cannot make such agreement in India law where we can fix the time when the custody will transfer to the other parents.. is it true? what should I do to get the custody of my child? the case is in Indian court..
