Can my Ex girlfriend still claim one of our children?
So my ex girlfriend USED to have physical custody of our 2 children, and we both had joint custody. At the time, I was paying $1200 a month in child support, and got the kids every weekend and 6 weeks in the summer so we went to court back in 2006 and agreed that we would each get to claim one of the children. This decision was agreed upon solely because as much as i did in child support. As of January of 2015, I now have physical custody because she moved across the country. I took her to court and I won Physical Custody. I also agreed in court that I would not make her pay child support. With the new court order that grants me physical custody, there is no language regarding who claims the kids. She got the kids for a total of 2 months last year during the summer, and has never paid a single dime to help with clothes or anything else since they moved in with me. So even though there was never an UPDATED court order in that regard, it is my understanding that she CANT claim either of the children, PER THE IRS, because she doesnt pay anything out to support them (Except for the 2 months she cared for them) but she insists that she is still claiming one of them because that is what on the 2006 court order.
