I am a mommy to an adorable 6 month old baby girl named Rowan. I am preparing to start nursing school in the fall. Meanwhile, I enjoy spending time with my family, trying my best to "live green" and do my part to help the enivronment, looking for new recipes for baby food, and reading books about anything that will help me be the best mother that I can be. I love life, I always try to see the good in people, and consider myself to be a pretty positive person. My family means the world to me, and nothing will ever change that!

  • Can a landlord make me sign stipulation if they accepted rent after eviction was filed?

    Hi, I have a quesiton about an 'eviction' that we are currently going through. I sent out the September rent, in time for it to reach the landlord by the 23rd of the month. About 3 weeks after the due date, I get a 3-day letter stating that they never received the check. I then contated the lawyer that handles the landlords property and he said they never got the check and that an eviction was started. I understand they have the right to do this, although I wish they would have let me known sooner that there was a problem. Anyway, 2 days after the eviction was started, I notice that the rent check that "NEVER GOT THERE" was cashed!!! I called and asked them why it was cashed and he said b/c they chose to accept it and they will enter a stipulation that we let them know when we will be out, and they will prorate the rent until we move. I agreed to that. It is my understanding that if they accept payment after an eviction process is started, then the eviction is then void. Well, I received the stipulation in the mail today, and it says that I am to pay court costs on top of the prorated rent for the last month. What I am wondering is, since they accepted payment after the eviction was started, and therefore is voided the eviction, then why do I need to agree to a stipulation? I don't feel that I should be reliable for court costs incurred when they were the ones who voided the eviction. I hope I am clear on what I am asking. I am just at a loss. We have NEVER been through anything like this before, and hate that we are experiencing this unfortunate circumstance. I just want to know what rights I have. With this guy being a lawyer, he knows how to toe the line between 'legal' and ethically right. I am willing to pay them everything we own as far as rent, that was never an issue. I just feel like if the eviction was voided by them cashing the check, why should I sign the stipulation agreeing to the court costs? Wouldn't they have to drop the eviction anyway due to accepting the money? Any help is greatly appreciated:) Thank you!

  • Adult being disowned by parents due to my brothers actions.?

    I am a 29 year old married mother to two children. Recently, my brother went through a split with his wife, with whom he has 3 children. They had been evicted from their home, and he moved in with my parents. They have plenty of room for him, but my parents were at their wits end with him and his sloppy ways. Oneday my Mom got mad, and kicked him out. With nowhere to go, he comes to my house and says he is only going to stay one night until he finds a place to live. That one night turned into two months! Not to mention, the night he first stayed was the first night we had at home with our newborn son. Needless to say, we have not had any family bonding time due to the fact that my brother has been here and sleeping on our couch. We got to the point where we were confined to our room for privacy. I explained to my Mom that we just couldn't do it anymore, to which she would laugh and reply "now you see what we went through!". Well, my husband came home from work oneday and saw the house a wreck from my brother kids and he had had enough. He told him he needed to find another place to live b/c we just didn't have the means here. So, my brother goes back to my parents. Well, now my parents have disowned me and my family, kids included, b/c he is back at their house. My Mom told me that I knew how unhappy she was with him there and could not believe that I would do this to her! Well, I have a family to raise and children to bond with. I need a stable environment for them. My parents have a 4 bedroom home, where he can go and shut himself in the room and they don't have to be bothered. I guess my question is...should I feel bad for this? I would think that my Mother would understand that I have a family to raise. She had a chance to raise her family, and I believe that her Son is her problem. I was being nice by letting him stay here for 2 months, but it was ruining my marriage and my family life. At this point my children and husband are the most important thing, and their well being and stable home life are my main objectives. I hate to lose my family over a bum brother, and have expressed that to my Mom. Basically, I just feel like we had the nerve to kick him out, so if she doesnt want him there, then she should do the same, not blame us! My oldest asks where Nana is and says she misses her...and not one time has my mom called to check up on them. I know this is kind of "all over the place" but can someone please give me some advice or insight as to what I should do! Any suggestions are much appreciated. Thank you:)
