    At approximately 9:30pm on September 8, William went to see his neighbour, John. William was upset because his cat was injured by John’s cat and, as a result, William had to take the cat to a veterinarian and pay $500 for treatment. When John answered the door and said that there was little he could do to control his cat, William went ballistic, started swearing and suggested that they settle the matter by fighting. After hearing this, John grew angry and agreed to fight William.

    John’s daughter, Suzy, pleaded with William, asking him not to fight with her father. Suzy said that John had a history of strokes and other illness. She tried to stop the confrontation, but was not successful. After a short fight, William threw John on the ground. The fight stopped when other family members intervened. At 11:30pm the same day, John suffered an acute heart attack and died.

    John, who was 63 years old, had a long history of medical illness. He had a history of strokes, suffered from diabetes, high blood pressure and triple coronary disease. He was on disability leave, was inactive and overweight. A stress test performed earlier reflected that he could not meet the necessary fitness standard to do such simple tasks as vacuuming, taking out the garbage, bringing in groceries, walking out of a subway or walking a number of street blocks.

    Medical evidence showed that John suffered a rupture of the plaque build-up in his right coronary artery, which led to the blockage of blood to John’s heart and his death. A cardiologist said that emotional or psychological stress could have been a potential trigger of a plaque rupture. However, he also acknowledged that it is often difficult to isolate specific triggering events and could not conclusively confirm that the fall during the fight subsequently caused the rupture.
