    I m going to be moving to Downtown San Diego this summer. I know very little about the area, and are hoping to get some insight, please. I d like to buy a condo somewhere (in a clean, nice, safe area) in the center of everything, but not too far from the marina. Any advise, or suggestions would be greatly appreciated.

  • Order to show cause and affidavit?

    I was told that an order to show cause and affidavit for contempt hold criminal charges. However the judges do not like to charge the parents in this type of case when children are involved. For a case like this in California, is it wise to hire an attorney or defend yourself knowing how the courts feel about a Contempt case?

    The charges that the party is claiming are false. Proof is in several emails from the claimant to defendant. In order for the judge to hear the defendants side and see the evidence/proof, and the things the claimant isnt doing what must I file or do? (I was told to file another contempt complaint is not adviseable).

  • If I stop making payments?

    If I stop making payments on my vehicle (because I still can't afford the payments) after filing a BK7 (reaffirming the loan) then a BK13 on it, can the lender or collections agency take me back to court to have my wages garnished or will it just stay with a collections agency?

    can I re-ad the vehicle to my BK7 if its been over a year or is it way too late?

    Is there anything I can do to bring these payments down?

  • Vehicle put in a bankruptcy?

    I includied my truck in a BK7 to get my interest and payment down, but was learned AFTER the fact that I should have filed a BK13. The BK7 only reaffirmed the loan. After filing the BK13, the interest came down and payment came down very little.

    I'm just learning that the truck shows as a charge off on my credit report. It doesn't show that I am making payments on time or that I am making good on the loan.

    At this point, I want to give the truck back and start over. It's not being reported on my credit report and I can't afford the truck payments.

    After filing both the BK7 and BK 13, is there anything else I can do to bring down the payments?

    Can I give back the truck or since the it has been reaffirmed, if I give the truck back will they come after me for the difference of what is owed on it after it has been sold. Can I just let a collections agency take over the loan and never pay it or will the lender or collections agency take me back to court and have the payments garnished?

    What can I do to get out of this?

    Please help.....NO RUDE OR STUPID ANSWERS PLEASE.

  • I am trying to change venues (counties)?

    The judge ordered the other party to pay for the change of venue. Even though the change was agreed upon in court, the other party refuses to pay for it. It is day 25 and the case is in limbo between counties (from Riverside to San Bernardino County) because of non-payment. Neither counties will allow anyone to respond or turn in paperwork because it is in limbo.

    I was told that I cannot pay the transfer fee because the judge ordered the other party to pay it.

    Is there anything I can do to help make the change happen? Is it legal to allow the case to remain in limbo for so long even though papers have been requested on a time line?

    Please help.

    If I was awarded a modification in my child-support, but my ex refuses to pay it, what do I do?

    I just filled out a wage assignment and am waiting for it to go through. In the mean time, is there anything I can do to try to receive it?

    Money is now being owed to me in arrears. How will I be able to receive this in its entirety? (There is an order for the other past amount to be paid to me in incriments, but how do I now receive the amount he is currently not paying?)

  • I was referred to an attorney to assist me with?

    I was referred to an attorney (by another attorney) to assist me with my custody issues. The attorney that I was referred to has done nothing for me that I haven't already done myself.

    I have filled out and filed paperwork myself (because he has always been too busy to do it for me.)

    I have given him money to file for an ex-parte hearing, but he never filed it and said that he did. I asked him to take the money that he didn't use and put it towards the transfer fee's. He said he did, but he did not.

    He added my child support and arrears wrong.

    He said that he did not need to get a signature from the judge for a wage assignment to be submitted, but my ex's (spouse) job said they won't accept it because it needs the judges signature and stamp.

    During court, the judge granted me my request to receive my attorney fee's back. He told the judge he wanted the money to go to him. When I tapped his shoulder in court and said that money is supposed to go to me, he said, "I know, this is how the money will be reimbursed to you. It has to go through me." (His statement did not make any sense because the judge asked if payments were going to be made out to me or him (the attorney).)

    Since that time he has been collecting the money and not giving it to me.

    Everything this attorney has said he would do has been a lie.

    This attorney told me he has been doing this for over 12 years. It appears he is in his first year of law school. I'm not sure what to do or how to do it. Do you have any ideas?

    By the way.......

    I have an e-mail copy of every conversation we had, (this is his preferred method of communication.)

    I have the retainer agreement and a receipt showing I paid the money in full.

    In in Riverside County, Ca.

    My ex is dating an unemployed paralegal who is helping him take advantage and take away all my parental rights. She personally told me she is looking forward to watching me lose everything including my kids. I have done nothing to her or my ex to receive such a negative behavior. I think she feels threatened because I am the ex after 20 years of marriage. This woman has made verbal threats to me and my kids in front of my boyfriend.

    I have placed a temporary restraining order on her and my ex because they are both talking about taking acts of physical violence that WILL lead to death.

    Can she do this and win just because she is a paralegal? Do I have rights against this? I thought I heard that a paralegal cannot get involved in a matter if they are emotionally involved in the situation. Is this correct?

  • Let me do this another way?

    I have a restraining order against my ex and his girlfriend for threatening me and my kids lives. (I also have a witness to the threat.) Yes it scared the crap out of me, but I've never been in this position before and I'm not sure what else he and his girlfriend (who claims to be in law somehow) can do to hurt and scare me. (So to the so-called attorney who is trying to make this seem like a scandal) I am curious if there is anything I can do to keep them from hurting me or my kids anymore. (The threat of killing me and my kids is scary and messes with the person psychologically.)

    I am a person who is scorned, but I am more of a person that is scared for me and my kids lives. I am tired of looking over my shoulder when driving, walking or just being out in public.

    If you have nothing positive or helpful to say, don't bother. Keep it professional and remember I am the one looking for help not insults from YA.

    My ex's girlfriend advised me that she has been in law for many years. (She left that statement wide open.) And I know she has been assisting him with his custody and child support needs. If she is in law (somehow) and assists him in doing or saying things that are not true, am I able to file something against her or have her charged with assisting him commit perjury?
