  • A question regarding enforceability of a contract?

    We are participating in a legal analysis project. The facts are as follows:

    Peggy helped 87-year-old Melvin care for his wife and aunt for several years before they died. Melvin then asked Peggy to "take care of him for the rest of his life." Peggy agreed. Melvin then conveyed his house to Peggy for "Ten and No/100 Dollars ($10.00), and other good and valuable consideration," which was indicated on the deed. Melvin also executed a power of attorney in Peggy's favor which would allow Peggy to assist Melvin with handling his financial affairs. Melvin then left on a trip to visit his brother. When Melvin returned from his trip, he learned that Peggy had locked him out of the house. Melvin filed a lawsuit against Peggy. Melvin claimed that he had deeded the house to Peggy in exchange for her promise to care for him for the rest of his life. Melvin also claimed that Peggy never paid him the $10.00. Peggy admitted she did not pay the $10.00, but claimed she made no such promise to Melvin and that Melvin had given her the house as a gift when he was unable to sell it. Peggy also claimed that Melvin did not take a trip, he intended to move out.

    We have multiple requirements in a paper we are to write, but the only one that I am concerned with is including precedent, at least two that support the conclusion that we come to. There is one in the reading materials that references events close to these, but the other I have no idea how to search for. Can anyone point me to a database where I can essentially plug in events like these to look for a conclusion courts would come to?

  • Some difficulty with a FIFO perpetual inventory problem?

    12/2: 5 units purchased @ $7

    12/9: 10 units purchased @ 9.40

    12/11 12 units SOLD @ $35

    12/15 20 units purchased @ $10.15

    12/22 18 units SOLD @ $35

    Using FIFO and a perpetual inventory system, the answer ended up coming out to $281.25. I'm not sure how that occurred, though. I thought it would look something like this:

    12 units sold = (10 @ 9.40) + (2 @ 35) = 94 + 70 = $164

    18 units sold = (18 @ 10.15) = $182.7

    $182.70 + $164 = $346.70

    Clearly I was quite off in my answer. Where did I go wrong, here?
