  • Personal liability after foreclosure?

    I have a house that's being foreclosed on due to bankruptcy. I no longer live there but have continued to carry personal liability insurance due protect myself in case anyone was to get hurt on the property. After foreclosure is complete (bank has formally taken it, but not sold yet), can I drop the insurance coverage? Or do I need to keep that coverage until the sale by the bank to a new owner is complete?

  • Where/how to get a mortgage just two years outside BK7?

    I had a BK7 back in 2/2009 due to a bad RE investment in FL and a divorce (nothing else was included in the BK, I reaffirmed all my other debt). Although the FL condo is no longer my responsibility, it has yet to sell and my understanding is that I'm not eligible for an FHA loan until 3 YEARS after it is finally sold. My credit has been very solid over the past two years and my credit score is in the lower 700's (725ish). Who will look past the FHA guidelines and consider giving me a mortgage. All my other ratios/numbers are very good now and I have 10% down. Other than the BK7/condo, my credit has been very good for over 20 years.

  • Getting an FHA Loan after BK Seizure?

    I have a rental house that was seized during chapter 7 bankruptcy proceedings. The house was not worth more than the loan balance, but no amount of discussion with the trustee convinced him otherwise as an RE agent told him there was value there. He's now finding out that I was right all along and after 18 months, has had no luck in selling the property. Meanwhile, the property sits on the market and is significantly overpriced for the area and it's condition.

    With that said, I have moved on financially and nearly financially ready to purchase another house. I know you have to wait 2 years after BK to get an FHA loan and longer if a foreclosure was involved, but I didn't give up my rental house, it was taken. Based upon current FHA rules, how long do I have to wait to qualify? 2 years? 3 years? Does the seizure of the rental house affect when I can get a loan?

  • How to get an FHA loan after bankruptcy?

    I filed Ch. 7 bankruptcy nearly two years ago and was discharged 1.5 years ago. Included was a Florida condo that I owned with others (it's now for sale) and the trustee siezed a rental home as an asset that still on the market. I've been told that until the last property is sold, my "clock" of waiting three years from BK to get an FHA loan won't start. Is that true? If so, how will an FHA underwriter know about the unsold rental properties as my credit report shows both loan balances as $0 and expected to roll off my credit report in about 5 years. Also, if true, what keeps a trustee from holding the property for YEARS preventing me from moving on and getting a home loan for a decade or more?

  • What's the name of that some?

    And who sang it? It's gotta be from the 60s I suspect. And the main words are "True Love". It's not the Cole Porter song or Buddy Holly either. Very fast paced song with lots of guitar work. Definitely a danceable song, but I can't come up with the official name or who it's by. Many thanks in advanced for any help! It sorta reminds me of the Romantic's "What I Like About You".

  • Responsibility for rental home lost due to bankruptcy?

    I went through Chapter 7 bankruptcy and to make a long story short, the trustee wanted my rental home as he thought it was worth more than I owed. After 7 months he has yet to put the place up for sell (although he kicked out the tenants in about 6 weeks). Now the insurance policy that I had is coming up and the trustee is saying *I* need to pick up that policy until the home is sold. How can I be responsible for a house that I don't even have keys to? Am I responsible? My lawyer says no, the trustee says yes. How long can the trustee just sit on this house like this?

  • FHA loan after bankruptcy?

    This past year, I went through chapter 7 bankruptcy and lost two properties in the process. The first was a rental home which was taken by the trustee as an asset. Its mortgage was in perfect standing up to the day the trustee took possession. Since then, he has evicted the tenants and made known his intent to sell. However, he has not paid toward the mortgage and the mortgage company has made known their intent to foreclose, even as the trustee is preparing to sell. The second property was a Florida condo that I owned with three others. It was worth far less than the mortgage, but the mortgage was in good standing when I filed chapter 7 as well. Since then, the property mortgage and deed have not changed (I'm still officially on both) although the trustee has accepted the condo into the bankruptcy, he abandoned the property. The other owners have now stopped paying the mortgage and are weighing their options of deed-in-lieu, short sale, bankruptcy and selling out right and taking the loss. Other than this bankruptcy, my credit has been perfect for over 20 years. Base on the above, how long will it be until I'm eligible for an FHA loan? 2 years? 3 years? If it's a certain period of time, does the time start the day I filed? The date I was discharged? The date my bankruptcy was closed or the date the last property changes hand so that my name is no longer on the deed or mortgage? I keep getting conflicting information, even from FHA lenders.

  • Chapter 7 and FHA loans?

    I recently went through Chapter 7 bankruptcy. During the proceedings the trustee took possession of my rental house that was in perfect standing with the mortgage company. Since that time, he's evicted the tenants and has not paid one penny toward the mortgage but has yet to put the house up for sale although he states that's his intent (it's been 7 months!!). Consequently, the mortgage company is now foreclosing. Given that the house is still legally in my name, but the foreclosure is not my fault, how well this affect my ability to get an FHA loan in the future?

  • Approval for an FHA Loan?

    I went through Chapter 7 in which the Trustee abandoned a property. However, a business partner who I owned the property with (both our names are on the loan and title) has yet to decide if he'll file bankruptcy, do a deed in lieu or try to work out an arrangement with the bank. Will this count against me as a foreclosure? I'm interested in cleaning up my credit and getting approval for an FHA loan in the future and wondering what affect this property will have

  • Will a partnership going to foreclosure hurt me after bankruptcy?

    I owend a condo in FL with 3 other people. No official partnership, just an agreement among us. I filed BK7 and was discharged in July. Property was not retitled, refi'ed or sold. However the other members are now trying to do a deed in lieu of forclosure. In trying to get an FHA loan in the future, will this count as a foreclosure against me even though I wasn't involved in the foreclosure or had a say in it? What if the other members go BK instead?
