  • If borrower doesn't pay, do co-signer's wages get garnished...here's the situation?

    My mother in law is foreclosing on her home, that my husband co-signed for *big mistake*. We can't do anything to help or pay for this home. she is 4 months behind right now *in michigan*, and she calls today and tells my husband that they can garnish his and MY wages. I know that they can ask for garnishment after the home is foreclosed and the auction is held, but they can't go after me, can they? I have a feeling that she is trying to scare my husband into helping, when we can hardly make it right now. She is on disability, so I'm sure they won't go after her for the money at all. What is the process on this?

  • Can we refinance into someone else's name?

    Can my husband and his mother refinance and have her boyfriend sign on as the co-borrower. We really want to move out of this house, we hate it and our family is getting bigger now. I'd love it if she would take over payments with her boyfriend, but we don't necessarily trust them to make the payments and put my husband's credit at risk. Can we go through the bank and refinance to put the boyfriends name on the mortgage? If so, is this really expensive? Thanks

  • Can my mother in law get into trouble?

    My mother in law may have forged my husband's name on an escrow refund check. She must have then deposited the check into her account, even though we have been paying on the house for 3/4 of the year. My husband is the co-borrower on the loan, but the check was written to them both - can she be turned in for forging his name?
