my brother was arrested in September 2014, the next day the news printed my name and face in the papers, I printed it out, they changed it later that day, however now if someone Googles my name, my picture comes up and is posted still on the newspapers website with the same date as the incident but with no story along with it it is just my photo. They said in the corrected story that "police originally misidentified *********"(our last name, no first name, I edited it out for privacy) and that was it. However they still have my picture up on their site and when anyone googles my name, or yahoo searches it etc, google images it is the second photo, yahoo it is the first photo, and you see it without opening the images portion of the site. It is a drunk mugshot of me at age 19 from a stupid night drinking. I have the original story printed from the site with my name, age, and photo filed safely away as evidence, I also printed out my name being googled and the updated version with my brothers name and photo. This was a serious crime involving commercial burglary!! Do I have enough here to sue for Defamation of Characer? More specifically liable, I understand that the story is no longer there but I have it printed out and if someone looks up my name they see a drunk picture on the towns main newspaper website, leaving one to believe I did something of criminal nature. One thing that I should probably obtain is the police report from that day showing it was my brother. Lawsuit???
