  • who presses charges the store or the attorney?

if you are caught shoplifting and the store does not press charges againts you .. does not call the police. does that mean that the person does not have to worry about getting a court date because the police were not involve. can the attorney call the police?

if the store manager and the lp caught someone stealing an item less than 30 dollars and was told that they will not call the police and even made her sign a paper that stated that if she understood that they could of called the police but did not do so. no police where call. only was told a fine which is a civil demand will be sent to her mailing address. if she pays the fine what are the odds of going to court?

  • shoplifting ??

i have talked to alot people in this page and am greatly thankful for some of your guys replies it helped me and my friend alot. as some of you guys already read my previous question my friend got caught shoplifting at kohls with a $28 item, the lp and the manager did not call the police because the item was not much, she is not allowed in the store also was told that she will be getting a fine from kohls attorney and she also sign a paper saying that kohls could off called the police but did not do so and if she understood that they could off called. they also took her info, s.s.n and picture.my previous question was if the police where not called does she have to worry about going to court.

from what i have read from your replies was that she doesnt have to worry about going to court because the police where not invlove and they have no record. but if she doesnt pay the fine then they can sue you and take you to court. am i correct.

  • shoplifting, but no police where called?

my friend got caught shoplifting in california last friday she is 18 yrs. the lp caught her trying to steal a $28 item. they took her to the office and made her sign a paper telling her that she is not allowed at the store. they told her they were not gonna call the police because the item was not that much. she told me that she also sign a paper that she will be expecting a fine from the store attorney which is a civil demand letter. my question is does the civil demand letter request a court date to appear. if no police where involve does she have to worry about going to court. if she pays the fine is it mostly over.

she also sign a paper that said that kohls lp and manager could off called the poilce but did not do so. and is she understood that they could have called but didnt.
