On the same day, their mother; Mrs.C had given Mr.A a piece of land, stipulating that he must pay the allowance to Mr.B. The house grant was still with the bank and will take few months to be returned back after Mrs.C settled the entire housing loan. Few months later Mr.A failed to pay the allowance.

Mr.B threatened to bring a legal action against Mr.A. The latter immediately banked in RM2000 as a settlement of 6 months’ default payment. Mr.A reminded Mr.B to return the money if he rejected the offer. Mr.B however used the money without any protest.

One fine day, Mrs.C received a call from the bank stating that the grant is ready for collection. On the same day Mr.B received last warning letter from the College for failure to pay the tuition fees. Being desperate, Mr.B accompanied his mother to the bank and later persuaded his illiterate mother to sign a letter of transfer to his name. He in fact told his mother that he is speeding up the transfer of land to Mr.A as promised. Subsequently, Mr.B sued his brother; Mr.A for the remaining balance.
