Both White Collar Crime and theft or burglary entails the taking of either property or money from someone or some entity. and compare how these crimes are the same and how they differ with respect to laws, the courts and sentencing. On September 5th, Babette was at a party at her 23 year old friend, Marsha’s, house.There were about 11-15 other people there, ranging in age from 20 to 30 years old.Gordo, who is a friend of one of the other guests, was also at the party. According to Babette, everyone else was drinking and smoking pot at the party, but she was not.At the party, Babette was wearing a tight short skirt, a halter top and 4 inch heels.

At around midnight, Babette went upstairs to go to bed. She took off all of her clothes and went to sleep. A little while later, she woke up and Gordo was on top of her, having sex.She said she told him to stop, but that he wouldn’t.She said she couldn’t really struggle or scream because of the weight on top of her.She explained that she didn’t wake up until after Gordo was on top of her because she is an extremely heavy sleeper.Babette did not get up when it was over and leave.At some point Gordo got up and left the house.Babette ended up sleeping there, and the next morning, she told Marsha that Gordo raped her.

Marsha, who is also friends with Babette’s mother, Delores, told her mother what Babette said, and Delores called the police. Marsha said that Babette was not drinking or smoking at the party because Marsha would never allow someone that young to do such a thing.

Gordo, when questioned, admitted that they had sex, but said he didn’t know that Babette was only 14 years old because she looked older, and he assumed that since she was at a party where everyone else was an adult, that she was an adult, as well. He said she “came on to” him, and that she was smoking pot and drinking beer, although he wasn’t sure how much she had of each.

Other guests at the party were questioned by detectives. Everyone said that they saw Gordo and Babette talking. A couple of people described them as “looking cozy”, but others said that they were just talking. No one heard any screams or struggles, but the music was pretty loud.No one really remembered either Gordo or Babette leaving the group because they were a little drunk, but Gordo’s friend remembered leaving the party with Gordo at around 3:00 a.m.They all said they believed that Babette was drinking and smoking, but weren’t sure.

While the detectives were interviewing Babette in the presence of Delores, it came out that about a month before, Delores had caught Babette having sex with two Navy guys behind a dumpster at a movie theater when Babette was supposed to be inside seeing a movie with a friend.She had been punished for this, and was in therapy at the time of the incident at the party.

Babette swears that the sex was non-consensual. Gordo swears she consented to having sex and that he had no idea she was so young.

In Babette and Gordo’s state, the age of consent is 16 years old. Having consensual sex with someone under the age of 16 years old is carnal knowledge, and is punishable by incarceration of 2 to 10 years in the penitentiary. Having un-consensual sex is rape and is punishable by incarceration of 5 years to life.
