I'm appalled at the attitude shown by the courts and by many of the responders here. Whatever the ultimate resolution of the illegal immigration problem, these are basically decent hard working people. If deportation is the punishment for their crime, that's fine. But it's important to recognize that the crime doesn't justify cruel and unusual punishment. Depriving someone of a family is unconscionable under any circumstance. If you want to punish anyone, punish the employers who are the ones who really create the problem.
You'd think illegals were taking jobs from some of the folks on this thread. Most illegals end up working in marginal trades, for less than marginal wages. If the folks responding here so venomously are incapable of finding better jobs than plucking chickens or washing floors for below minimum wage, then they should save their complaints for a question on the American educational system.
The ultimate solution to this question has to take into account not simply the law that was broken, but the economic factors that create a market for illegal labor. Instead of trying to fight natural market forces, it would be smarter to recognize that low cost immigrant labor adds far more to the US economy than it takes away. This is the way it's been since the first Irishman, Jew, African, Chinese, Greek, German, Russian, HUngarian, Pole or Italian stepped off the boat. So before you start railing about Mexicans, look in the mirror: you, too are no better than wretched refuse. Rather than going through the hypocritical and un-American sham of criminalizing immigration, let's figure out how to bring it out from behind the curtains. Manage it, tax it, make it a formal part of our economy. Everyone will benefit.

Having a kid in the US, just so they can be a citizen, does not give the ILLEGAL alien parents a free ride. Anchor babies should not be allowed! This was not the intention of the men that passed the 14th amendment!!!!!!
BTW, the ILLEGAL alien criminals are hurting efforts on the "no child left behind" because teachers can't teach their classes properly. They are so busy worrying about the non-English speaking kids they can't teach all the kids!
This law has nothing to do with illegal aliens and the proper deportation of the illegals.
Do you think all law breakers with children should be exempt from being imprisoned? This does break up families, and often over non violent offenses. At least we only deport illegals who have broken no other laws. They are free to take their children with them. And if they choose not to do so, we can always find group homes or foster care for the ones with no relatives able or willing to take them. This is exactly what we do with the children of citizens, so why should the illegals or their children receive special treatment? My bad, I forgot. They DESERVE to be treated better than we are treated, don't they?
It really doesn't matter that the children of illegals who are born here are considered citizens. They are not the property of this country because of that and can be taken with their parents. IF they choose. Why would they leave them here? As an excuse to come back?
Did their parents think about their children being left behind before they created this situation?
Or should I say, did their parents COUNT on people like you to let them use their children to stay here?
Their children may have been born here, but they shouldn't have been. Meanwhile, when parents break the law, be it embezzling or illegal immigration, the consequences can separate them from their family.
What do you think happens to American children when one or both of their parents gets thrown in jail? Does being a parent exempt you from abiding by the law? What about the spouse or children that are left when an illegal kills them while driving drunk without a license? What about the families who are left with credit ruined and all the expense and headache of clearing that up from identity theft? What about our own citizens and children? Don't they matter?
Frankly.....I don't care. They are minor children of illegals and should be deported with them. Seems to me if they were worried that much about their children they could take the necessary steps for "plan B" if they get deported, killed or put in jail. It's THEIR problem....not mine. They are the ones who should feel guilty for putting their children in this position.
