The media have been telling us to watch the gun-control case now before the U.S. Supreme Court, where we await a decision about Americans' Second Amendment rights. But the Second Circuit Court of Appeals just handed down an equally important gun decision that has additional implications against judicial supremacy.
The Second Circuit, which convenes in New York City, shot down the [gun control proponents] longtime dream of achieving gun control by suing gun manufacturers for crimes committed by firearms. In a remarkable decision, this federal appellate court dismissed City of New York v. Beretta U.S.A. Corp. (pdf) and protected gun corporations against frivolous lawsuits in state and federal courts. I always wondered about the idea of sueing a manufacturer. If you were run over by a drunk guy driving a Ford, could you sue him, the guy that sold the drunk the booze, the guy that sold the drunk the car and FORD? Maybe there should be a background check on every person buying a car to see if they have a drinking problem. Knowingly selling a drunk a car does seem a bit like selling a lunatic or a criminal a firearm. But sueing the folks that built the car? I dunno...that would be a stretch. Now if a firearm manufacturer knowingly sold guns to a wholesale house that the manufacturer knew sold firearms to shady retailers I suspect they would have some explaining to do as there is a question of due diligence...or at least an argument could be made for that. In the end I don't think that anyone who wants to legally purchase a firearm need fear that the right to do so will be unduely restricted...it won't like the old days when you could send off for a pistol or rifle by mailorder (them were the days) but there won't be too many more hoops to jump through except in those seven states that don't have a Right to Bear Arms clause in their state constitution. On the other hand it would be a good idea to keep you ears open on the subject....'ya never know....no kiddin'!
Yes it is a big Victory, but as long we live in THE UNITED STATES OF AMERICA I am afraid that some one else will go at it again. They will always be some one who is trying to take our guns away. It is Sad; I had a gun that I used for the job I had after I had got out of the Air Force. There are times a gun will come in and safe some ones life.
My partner and I were robbed at the place we worked out of it was the shop where we parked our armored car. We both had guns but we were caught because we were in the shop and thought that it was safe. The other man had the drop on us so our guns were no good at that time. My weapon did pay for itself because being able to just get my hand on the weapon and the threat disappeared. I used my weapon in the way it was meant to be used, not no John Wayne type. Don't get me wrong I Love John Wayne too bad he died so young.

I hope the Supreme Court of the United States of America will do the right thing and let us keep our weapons.
Well I agree with the court but if that's the case then how can people sue over cancer related to smoking cigarettes? The basic idea is the same, people know smoking can and will kill yet people still do it so how can the companies be held liable? The gun companies make a product that is for killing yet they do not kill people. The people who pull the trigger are the ones to blame not the companies. I see the courts ruling as in line and not considered creating law from the bench. I wish more courts would do that.
