I just found out that my step-daughter lied about being molested. The man is serving time in jail. What can i?
do to get him released? She was co-erced by her mother and we've always suspected this to be true. The ex-boyfriend took a plea because he had a very bad atty that told him that he was looking at 25 years if this went to trial and the daughter testified in front of a jury. There's was no proof. Just her word against his. He is totally innocent. She was only 9 y.o. at the time. Her story has changed several times since we have gotten to ask her questions. Her mother instructed her to NOT ever talk about it to her father. This man plead down to assault on a child w/SBI and does not have to register as a sex offender. Originally got 5 years but probably out in about 3 years with good behavior. Nothing sounded right from the very beginning. The mother was very vindicitive because he left her and she was getting even with him and her story has changed several times as well. What can I do to help this man???

You should contact his defense attorney.
Do NOT go to the DA first - they will do everything within their power to dissuade you from proceeding, and to 'coach' the girl into changing her story again and saying it did happen.
DA's do NOT like to be reversed, and will fight tooth and nail to keep a conviction from being overturned even if it is obvious that they are innocent.
In this case, though, the fact that he pled guilty will make it VERY hard to successfully seek to get the conviction overturned anyway.
I have to disagree, by the way, with your assessment that advising him to take a plea to assault/SBI for 5 years and no sex offender registration means that he had a bad lawyer. Juries tend to believe child sex abuse complainants, and to gloss over inconsistencies or contradictions in their stories as being the result of the trauma itself. Laws to protect child witnesses virtually prohibit any sort of aggressive cross that might reveal parental coaching. The lawyer was probably right - had the case gone before a jury he very well might have been found guilty on all counts and got the 25 years plus level one sex offender registration.
i might definately document this. A father could by no ability communicate approximately his daughters "****". Nor could he ever have a courting together with his underage step daughter. on the same time as no longer something might ensue, it is not properly well worth the prospect. Custody could by no ability acquire to everyone who has a lot of those recommendations/movements in direction of youthful little ones.
Go to the DA's office IMMEDIATELY. Dont wait, it takes time to get people out of prison. Take your step-daughter with you, and do NOT tell her mother before you do. Her mother is going to jail, definitely.
Also, dont worry about your step-daughter, its extremely unlikely that she'll have any charges filed against her since she was so young when it happened. Even if they're filed, there arent a whole lot of people who would convict her.
