If you caught a man molesting your 5 yr old daughter, and you killed him in rage, is it excusable because...?

you used deadly force to protect your daughter? Personally, I agree it is justifiable. Does anyone disagree? (read story before answering)

This story from AP, briefly: a man heard his 5 yr old daughter crying behind the barn, and ran to her. He found a man sexually molesting her. (proven by DNA afterwards). The father pummeled the molester with his fists, until he realized the molester was dying. The father then frantically called 911 and asked for emergency services. The molester, found with his pants and underwear down, died from his injuries. The father was not charged, because it was considered justifiable deadly force to protect his daughter. Agree or disagree, and why?

    That is a sad situation. I hope the media leave these people alone, they have gone through enough. Obviously the man didn't mean to kill the assailant but his emotions and his own strength did kill him. I would not want to see this father prosecuted. I understand the situation completely. There is a woman in my community that murdered the man who was sexually assaulting her son. The difference was she had the time to go get her gun and follow the man to his house where she shot him dead. She was tried for manslaughter. Everyone felt very sorry for her too. Instead of sending her to prison, she was kept in the local county jail, where her family could come and see her. Long story...I just hate when things like this happen. Poor, poor family.

    To be honest this is BS, if the attacker didn't have a weapon there is no way he could prove that he had to use such a deadly force to protect the child or himself. Period.

    Temporary insanity? Definitely possible. I can imagine that a father could possibly go into such a state under such circumstances.

    If you're asking me is it justifiable to kill in such a situation OUTSIDE of the state of temporary insanity and/or daughter/self-defense, meaning...doing it consciously as a form of revenge, the answer is: although I can understand the parents, it is definitely NOT justifiable.

    Quite the opposite, that's why the modern civilizations have the justice system in place...laws, enforcement agencies...so that justice would be served for the victim, but executed ONLY under specific well set and pre-determined terms by the state - the people, no one else, individually.

    If each person individually would take "justice" into their own hands, based on their own subjective perception of justice we would be living the anarchy, where the rule of the strongest would be the only law.

    Because of that, there is no exception, revenge is NEVER right...it can be understandable - yes, but right - never.

    I'm reading a book by Jodi Picoult at the moment which deals with this same issue - only it was the mother who shot the perpetrator.

    I have no idea what would happen if I caught someone doing that. I know when my own sons were molested by a neighbour, I wanted to kill him.

    The rage is excusable. It's not justifiable. But excusable and I would not point a finger of blame.

    I can't see how that could be justifiable force to protect his daughter. She was no longer in any danger the moment the father dropped him. Any further blows were not justifiably as far as protecting is concerned.. He must have got off for other reasons and rightly so. He could not have been classed as being in a right and sane mind, as a shock like that is horrific.

    100% justifiable. Even if he didn't have the deadly force of protecting his daughter thing, every parent would understand temporary insanity.

    As a parent of young children, my heart goes out to this guy and his daughter.

    I'll have to agree with Gender Stu on this one. The father was justified in protecting his daughter. Deadly force is only justifiable when one is in fear for his/her life. Was the father in fear for his life or his daughter's life? It will ultimately be decided in court if charges are pressed. And what if the molester was a woman? Would the public opinion be the same? Even though there was evidence after the fact of molestation, what if it hadn't been molestation?

    Let's say Ed is at a social gathering. He goes around the back of the barn looking for his own child. While doing so, he ends up stepping on a girl's pet hamster she let outside. The guy bends down to check the hamster and gets blood on his hands. The girl yells out "Daddy, help me. This mean man hurt my hamster." The father hears "Mean man hurt me." He runs around the barn to see Ed kneeling down in front of the little girl with some blood on his hands and on her clothes (she picked up the hamster). The girl is crying and maybe she is even hitting Ed. The father goes into a rage thinking Ed hurt his daughter and kills Ed.

    He was protecting a young child, his daughter. Who can blame him for what happened? Especially since he and his family tried to save the pedophile's life.

    I just hope that sicko didn't get too far into his assault on the little girl, and that she will not be damaged for life because of this.

    'justifiable homicide' exist for cases like this. he sounded frantic on the 911 call. he felt far worse about his action than i would have. caught in the act with his pants around his knees and a 5 year old little girl? any male above that has a problem with killing him is the very definition of an anti MANLY Man... i guess that would be a girlie man and the perfect example of pu$$ification.

    What a psycho. I've been raped before so I've been in that position myself and would still never beat someone to death. That'll just make me just like them a crazy psycho. He shouldn't have done that she was no longer in danger for you to just keep hitting and hitting and hitting.
