I know this guy from Japan and for whatever reason he had his Documents taken away and is still staying in the US....Is he an illegal now? even though hes got social security

He could have a social security number that was either obtained when he was legal, or scammed from someone else.
If he doesn't have a current visa or a green card, he's in the country illegally.
