First off, if u don't have the money to pay back, u can't pay it back. right? Do u have the renewal fee? (the amount it cost u to take out the loan?)Sometimes they'll let u pay that until u'r next payday. If u don't have that either then call the payday place and ask to speak to the manager. Explain your sitiuation. In most cases they will let it go until next payday. However, if this is a constant problem, they may not work with u.They will call the bank to see if funds are avaiable and withdraw them. Last step is court. At any cost try and resolve the sitiuation as soon as possible, court will be more fees. Surely u don't want that. Good Luck

They would have a full slate of legal remedies, like suing for the money, plus garnishment of wages, attachment of property, etc. If they could prove that the money was borrowed fraudulently (without the intention to pay it back), they could get punitive damages, and could basically own you until it's paid.

This just happened to me this past week and it also is from Advance American. I called the branch and was very honest. They extended my payback another two weeks. For my sister, about a year ago, they allowed her to make payments. They don't like to do that, but they like it better than not getting any at all. They are not going to begin any legal procedures or send an officer to your house and blah, blah, blah, as long as you are honest with them and do your best.

They will try to take the money out of your account anyway, and when it doesn't go, they start collection proceedings on you and report you to credit agencies immediately which ruins your credit score and makes it nearly impossible to get a credit car, approval for a loan, etc.
