Can a bailiff take HP goods, such as a car?
I have scrupulously checked this on the internet, but cannot seem to find an accurate answer as to wheather HP goods can be siezed. Although, i was under the impression, if you hadnt paid for it, then it didnt belong to you unless final payment had been made. Does anyone know the accurate answer to my question?

The baillif has come for a parking fine i knew nothing about and has nothing to do with the HP company relating to my car. First and only thing on his list is the car!!!
Trying my hardest to get through to citizens advice but having no luck....thank you all for your help...much appreciated.

Yes and know ..if the car is a Registered Taxi then NO... ( it comes under " Tools - of -the Trade " ... if it a Doctors car ..then NO... same rule applies... they can take it if you cant prove its on HP.
PS if you have payed more than 1/3rd of the Total cost of the car then Technically its yours... ( only applies to the Car Hire company )

Right OK we have start at the beginning ... it is very unlikely that you would not know about the parking ticket. You have proved to the bailiff that you live at the address so in the eyes of the law you would have received the numerous requests for the money.
Bailiffs in England are appointed by the courts all other people are doorstep debt collectors and they are not entitled to take anything from the house but shall set up a payment plan for you.
Court appointed bailiffs can not take HP products, you are correct in saying that these are not yours until you have made the final payment.
If a debt collector from the car company is coming then they can take the car. Other then that know

When you buy something on HP it remains the property of the seller until the final payment has been made. Under these circumstances a bailiff can not take it as its not yours to give. I should think you would need to prove that it is on HP for them to believe you.
If however, you took out a loan (even from a car company) and paid for the car outright and are now paying back the loan - the car is yours and they can take it.

They can take any HP goods if they belong to the company who employed the bailiffs in the first place but otherwise I don't think so, as long as you produce paperwork to say it doesn't belong to you yet. Check out the citizens advice bureau if you are in UK, they'll give further details

short answer - the car isn't yours so can't be seized.
long answer - you have ot prove it. You need ot show to bailiff (and if you can a clerk of the court) documentary evidence that the car is not yours (the HP agreement will usually do). Its ok arguing thats it isn't yourcar when its going onto the back of a lorry - try getting it back again afterwards!

the only way a baliff can sieze hp goods is if they are siezing them for the hp company, you dont own hp items till they are paid off

You are correct, goods on HP are not your property until they have been paid for in full, they still belong to the seller

not sure about the legal stuff, but if they come to collect if you have a driveway leave the gates open so they reverse in then get a mate to block them in with a car and leave it there. they are now parked illegally on your property. if you have to pay parking rates in your area the law is on your side.

i think you will find that they will take it, then think later. I had some at my door for an old resident when i just moved in to my rented house. They did not care i had to try my hardest to justify myself and explain that i was telling the truth - that he no longer lived at my address.

erm like yeah they can take a car that bought for fair and square too.i know a guy who is a repo man ..hes a customer at my work and hes such a t osser.i hate him.
