Bankruptcy???
Does anyone know if I could put my newborn sons doctors bills under my Bankruptcy???
Thank you everyone for your answers and no I have no filed yet either. I will not file till the end of Sept. beginning of Oct!!!

Wow, that is a great question. It is always best to check with an attorney in your area to see what the general rule of thumb is. While Bankruptcy is under a Federal Code, generally, each state still has different policies for different things. The October 17, 2005, Amendment to the Bankruptcy Code or Bankruptcy Reform Act of 2005 has left a lot of attorneys and paralegals alike scratching their heads for answers on questions that used to be simple.
Now while understanding you have not filed, I would assume that since your son is not of legal age, the Court would consider this debt as being your own. I have filed a number of bankruptcies where clients have had children, and have included their hopsital care for child birth in the bankruptcy. I do not forsee a problem in this.
Also, something to note while on the subject of medical bills is that in some states, any medical bills that your spouse has may also be considered a joint debt (meaning yours too!) whether or not your name is on it. You will need to ask your attorney more about it when the time comes- but North Carolina is an example of a state that practices this.

Depends on the date of the debt - if you filed for bankruptcy, only debts before the bankrupcty are included, it doesn't matter the date the services were performed, it's the billing date from the doctor.

Yes, if the service was performed before the filing date. The billing date does not matter.

You should absolutely put them under your petition for bankruptcy. It depends if you have had your final court date. And provided that it has not been discharged. At least that is my understanding. Yea call your attorney and see what she/he says. I am a tax payer and I also understand that sometimes bad things happen to good people and people should also try not to judge someone if they haven't walked in their shoes. I believe in getting help if you need it and giving it when you can. Good luck sweetie and I hope things will work out for you.

Since you are the Dependant and the bills go to you, then yes, you can put them on your bankruptcy.

the best thing to do is to make arrangements with your debtors and pay your bills. Don't milk the taxpayer for your failings,.

yes.....I hope yo find a way out before it comes to that..BK last for 7 years..it's better to let them go...they'll be off in 7 years...unless they are big
